INSURANCE NOT ON FILE <br />WORK MAY ~ PPROCEED <br />CLERK OF COUNCIL <br />DATE: 6-11"°~ ~ <br />o: PYrAC~X.s. ~" <br />FIRST AMENDMENT TO AGREEMENT <br />THIS FIRST AMENDMENT TO AGREEMENT is entered into on June 30, <br />2006, by and between Field Data Studies dba Southland Car Coiunters, a California <br />corporation ("Consultant") and the City of Santa Ana, a charter city and municipal <br />corporation of the State of California ("City"). <br />RECITALS: <br />A. The parties entered into Agreement A-2005-114, dated June 6, 2005, (hereinafter <br />"said Agreement") by which Consultant has provided traffic counting and data <br />collection services. <br />A-2005-114-01 <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />amend the term of said Agreement. <br />`vr <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />First Amendment to Agreement, the parties agree as follows: <br />1. Section 3, TERM, shall be deleted in its entirety and replaced with the following: <br />'`This Agreement shall commence on June 6, 2005 and terminate upon expenditure of <br />allocated funds, unless terminated earlier in accordance with Section 13, below." <br />2.
