INSURANCE ON FILE WORK MAY PROCEED UNTIL INSURANCE EXPIRES 7- (-0 7 CLERK OF COUNCIL DATE: Inv V FIRST AMENDMENT TO LANDSCAPE MAINTENANCE AGREEMENT A-2006-020-01 THIS FIRST AMENDMENT TO AGREEMENT, is entered into on March 15, 2007, by and between Vista Del Verde Landscape dba Bevill Landscape Management ("Contractor") and the City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). RECITALS: A. The parties entered into Agreement #A-2006-020, dated February 6, 2006, (hereinafter "said Agreement") by which Contractor has provided landscape maintenance for certain City parks. B. In accordance with the terms and conditions of said Agreement, the parties wish to amend the Scope of Services to clarify their intention that Contractor will provide services for additional park sites. WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms and conditions of said Agreement, except those amended in this First Amendment to Agreement, the parties agree as follows: 1. Section 1, SCOPE OF SERVICES, shall be amended to include in Exhibit A, Attachment 1, the following parks which will be maintained by Contractor: • Saddleback View Park (Patricia Lane) $380/mo $4560/year • McFadden Triangle Park $360/mo $4320/year • Flower Street Bike Trail Extension $265/mo $3180/year 2. City and Contractor agree that Saddleback View Park and McFadden Triangle Park have been maintained by Contractor since September 1, 2005. Flower Street Bike Trail Extension has been maintained since December 22, 2006. Payment for these additional services shall be made from contingency funds for the 2006-2007 fiscal year. 3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in full force and effect.
