NEC BNS cooperated <br />extensively with the DOJ's investigation, and ultimately pied guilty to one count <br />each of wire fraud and antitrust violation; the company paid $15 million cash in <br />fines and restitution, and provided ongoing maintenance, equipment and <br />services valued at $5.6 million to a number of School districts. <br />On June 30, 2406, the FCC declared NEC BNS and its successors and assigns <br />ineligible to participate in the E-Rate program for a period of six months that <br />expired December 31, 2006. ~fhe FCC limited its E-Rate debarment action to <br />exclusion from participation in the E-Rate program only. The FCC E-Rate <br />debarment does not apply to any other federal agencies, contracts or <br />programs. Thus NEC BNS (and its sr.rccessors and assigns) was declared <br />ineligible to participate in the E-Rate prograrn for a period of six months. <br />Unrelated to the disposition of the above-referenced matter, the assets of <br />several NEC companies, including the assets of BNS, were combined to create <br />NEC Unified Solutions, Inc. Thus, as BNS' successor in interest, NEC Unified <br />honored the FCC's debarment of BNS frr~m the E-Rate program for the six <br />month E-Rate debarment period. Neither NEC Unified nor any other existing <br />NEC entity, however, is presently suspended, debarred or otherwise ineligible <br />to receive any federal, state or local contracts. <br />12. What percent of your base business consists of servicing and supporting NEC <br />telephone equipment? <br />{ref. section 6.2.f} <br />NEC Unified as the sales and service arm of the manufacturer has as it's core <br />business the sales and support of NEC products. Over 90% of our base business <br />consists of servicing and supporting NEC telephone equipment. <br />14. A description of the qualifications, experience and abilities to provide telephone <br />system maintenance services of the Proposer's candidate on-site technician, <br />backup technicians, and any other on-site engineering and service staff. ? <br />{ref. section 6.2.g} <br />The candidate for the on-site technician position is Armando Saenz. Armando <br />has been with NEC and has held the position of ors-site technician for The City <br />for over 12 years. Armando is certified on the equipment currently installed at <br />The City as well as a Certificate of Achievement for completion of Category 5 <br />raining as approved by BICSI standards and codes. Armando is very familiar <br />with the telecommunication infrastructure at The City as well as the personnel <br />and policies. <br />The backup technicians to support Armando have also completed certification <br />classes for the equipment being used by The City. <br />Page 29 of 43 <br />
