INSURANCE NOT REQUIRED <br />WORK MAY PROCEED <br />CLERK OF COUNCIL <br />DATE: /0- 30-PO7 <br />0 ; RaCIcs,ReC ,may Svcs . �2� <br />t„urla 1),wKm <br />MARKETING AGREEMENT <br />N-2007-126 <br />THIS AGREEMENT, made and entered into this 161h day of October, 2007 by and <br />between STATE FARM MUTUAL AUTOMOBILE INSURANCE COMPANY on behalf of <br />itself and its subsidiaries and affiliates (hereinafter "STATE FARM"), and the City of Santa Ana, <br />a charter city and municipal corporation organized and existing under the Constitution and laws <br />of the State of California (hereinafter "City"). <br />RECITALS <br />A. The City has installed an electronic scoreboard and marquee at the Santa Ana Stadium <br />facility. The City desires to generate revenue through the sale of ad space on the <br />marquee and scoreboard and commercial time on the scoreboard. <br />B. STATE FARM desires to display its logo on the Stadium Marquee and scoreboard and <br />purchase an advertising spot on the scoreboard. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />1. SCOPE OF SERVICES <br />City shall display STATE FARM's advertising as follows: <br />• One panel (4 ft. x 7.5ft.) on the Santa Ana Stadium Scoreboard <br />• Two 15-second advertising spots on the Scoreboard at each high school football <br />game <br />• Recognition on the Stadium marquee at the corner of Flower St. and Civic Center <br />Drive <br />• Advertising space (1/4 page) in City's Leisure Class Brochure, twice annually. <br />• STATE FARM, will have exclusive home/life/auto insurance advertising rights <br />at the Stadium. <br />• STATE FARM will have title co -sponsorships (with Target) at the City's <br />Antique and Classic Car Show and the City's Children's Winter Holiday Party. <br />• STATE FARM will be entitled to have two banners (4'X10') posted at the <br />games. Banners provided by STATE FARM. The City will post and take down <br />at each game. One banner would be placed on each side of the field (facing <br />home and visitor side). <br />STATE FARM will work with City's contractor, Daktronics, to develop/produce and install the <br />copy for the Scoreboard and Marquee and the advertising spots for the Scoreboard. Upon <br />STATE FARM's approval of the advertising spot, Daktronics will deliver a CD containing the <br />advertising spot for use during the football games. <br />Advertising copy shall not promote 1) any material which the City, in its sole discretion <br />determines is offensive to community standards of good taste, 2) alcohol and/or tobacco products, <br />3) sexual enhancement products or services or 4) drug or pharmaceutical products. <br />
