The parties shall be responsible 50150 for payment of the arbitration fees and charges <br />incurred in any arbitration. In the event that a dispute arises between the parties as to the <br />reasonableness of the arbitration fees and charges, or the necessity of the fees and charges by <br />virtue of the conduct of one of the parties, the matter shall be submitted to the appointed <br />arbitrator for decision and allocation, if any, of the fees to be paid by each respective party. The <br />decision of the appointed arbitrator shall be final. <br />4.5 Compliance. If the Inspection Report for any of Owner's Properties finds any <br />deficiencies and, as a result, Agency does not then issue a Certificate of Compliance for such <br />Property, Owner hereby agrees to bring that Property into compliance with the Property <br />Standards not later than (subject to possible extension pursuant to Section 4.6 below) the fourth <br />(4"') anniversary of the Implementation Date. Such compliance shall be determined by another <br />inspection of the Property by Agency in accordance with the procedures outlined in Sections 4.1, <br />4.2 and 4.3 above. <br />If Owner proir ptly remedies all of the deficiencies cited in the initial Inspection Report <br />and schedules the subject Property for reinspection by Agency within one hundred eighty (180) <br />days after the date of the initial Inspection Report or the Implementation Date, which ever is <br />later, then the scope of such inspection shall be only to determine if Owner has satisfactorily <br />remedied the deficiencies actually cited. If, however, such reinspection is not scheduled by. <br />Owner until a date more than one hundred eighty (180) days after the date of the initial <br />Inspection Report, then the scope of such inspection shall again extend to the entire Property and <br />not just to the deficiencies cited in the initial Inspection Report. <br />If, upon reinspection, the Property is found by Agency to be in full compliance with the <br />Property Standards, Agency shall promptly issue to Owner a Certificate of Compliance for the <br />Property. If the Property is found not to be in full compliance, Agency will issue a follow-up <br />Inspection Report to Owner stating which deficiencies cited in the initial or a reinspection Report <br />are not in compliance and Owner shall promptly commence to remedy the deficiencies cited in a <br />follow-up Inspection Report. If Owner promptly remedies all of the deficiencies cited in the <br />follow-up Inspection Report and schedules the subject Property for final Inspection by Agency <br />within ninety (90) days after the date of such follow-up Inspection Report, then the scope of such <br />inspection shall be only to determine if Owner has satisfactorily remedied the deficiencies <br />actually cited in that follow-up Inspection Report. If, however, such final inspection is not <br />scheduled by Owner until a date more than ninety (90) days after the date of that follow-up <br />Inspection Report, then the scope of such inspection shall again extend to the entire Property .and <br />not just to the deficiencies cited in that follow-up Inspection Report. <br />If an owner can prove that a deficiency has been corrected by showing appropriate <br />receipts for and photographs of completed work and that the improvements were daanaged due to <br />forces beyond the owners control (for example tenant destruction of property), then the Inspector <br />may consider the improvement(s) as complete with the condition that the Owner provides proof <br />that improvements have been restored within a reasonable amount of time by way of dated <br />photographs and receipts. Certificates of Completion will not be granted until this is done. <br />8 <br />
