6.3 Enforcement of Easement. The easement granted in this Article VI shall not be <br />extinguished by the present or future vesting of rights to the dominant estate and rights to the <br />servient estate in the same person or entity. This Article VI is not intended to create enforceable <br />rights in any tenants of the Units in the Project. <br />6.4 No Easement by Implication; Prevention of Prescriptive Rights. Neither the <br />execution of this Declaration nor the granting or declaring of the easement set forth in this <br />Article VI shall be deemed a grant or declaration of an easement or easements to any third party, <br />except to the extent that the easement provided for herein run with the land, nor an establishment <br />of an easement or easements by implication, and Owners and the Association each understand <br />and agree that the only easement made and granted or declared by such parties is the easement <br />which is expressly made and granted or declared by this Article VI. Each Owner hereby reserves <br />the right to eject or cause the ejection of, from its respective property, any person not authorized, <br />empowered or privileged to use such property pursuant to the terms of this Article VI. Each <br />Owner further reserves the right to restrict access to its respective property for such reasonable <br />periods of time as may be necessary to prevent the acquisition of prescriptive rights by any <br />person; provided, however, that prior to the imposition of such restrictions on access, the Owner <br />exercising such right shall give written notice to the other parties of its intention to do so and <br />shall coordinate such restriction of access with the other parties so that no unreasonable <br />interference with the operation of the Project shall occur. <br />6.5 Unimpeded Access. The Owners hereby declare that at all times there shall be <br />free access between and among the parking areas within the Project, which free access shall not <br />be impeded by continuous barriers, fences, walls, buildings or other impediments to the <br />integration of the parking areas within the Project; excepting that if reasonably necessary, such <br />access may be reasonably impeded by the Owners, and their employees, agents, contractors and <br />subcontractors, for the purpose of any maintenance or repairs to the improvements located on <br />such Parcels. The access rights provided herein shall not include the right to park on an Owner's <br />Parcel. <br />6.6 Easement Use. Subject to all existing and fixture rules and regulations adopted <br />for the use of the Parking Areas as provided in this Declaration, the use of the easement provided <br />for in this Declaration shall be nonexclusive and shall be for the use and benefit of the <br />Association, the Owners, and their tenants. The Common Improvement Areas shall at all times <br />be used in conformance with applicable laws, including without limitation the City Municipal <br />Code, <br />6.7 Right of Use. Each Owner shall have the right at any time and from time to time, <br />to remove, exclude and restrain any person from the use and enjoyment of the Common <br />Improvement Areas on the Parcel owned by such Owner, excepting the Association, the Owners <br />and their tenants. <br />EXHIBIT E: Page 17 of 24 <br />
