7.11 Application of Fends. Funds collected from the delinquent Owner will be <br />applied to its Association account as specified in Section 7.9 and will be returned within thirty <br />days to the City of Santa Ana's contingency funds account up to an amount that contingency <br />funds were received by the Association from the City. Funds returned to the City will include no <br />interest, fees, or other charges and are to be placed directly into the City's contingency fund <br />account to restore it to its former level. <br />VIII. CITY RIGHT OF REVIEW AND ENFORCEMENT <br />The City of Santa Ana ("City") shall have the following rights of review and enforcement <br />with respect to this Declaration: <br />8.1 City Approval of Amendments. Changes or amendments to this Declaration: <br />must be approved by the City. The Association shall give the City notice of any proposed <br />changes or amendments to this Declaration by mailing a copy of the precise language of the <br />proposed change or amendment to the City, addressed to the City of Santa Ana Executive <br />Director of Community Development, P.O. Box 1988, Santa Ana, California 92702 (or such <br />other address as the City specifies in a written notice to the Association), together with a letter of <br />transmittal explaining the proposed change or amendment in general terms. The City shall have <br />an opportunity to review and approve, disapprove or submit written comments upon the proposed <br />amendment for a period of not more than twenty-one (21) days from the date such notice is sent, <br />provided that in exigent circumstances the Association may specify a shorter time period for <br />review and comment, which time period shall not be less than ten (10) days from the date of <br />sending such notice. If the City submits written comments within such time period, the <br />Association shall incorporate the City's comments into such change or amendment to the extent <br />feasible, and shall resubmit the proposed change or amendment to the City, and the City shall <br />have an additional fourteen (14) days to approve or disapprove such revised amendment or <br />change <br />8.2 City Enforcement of Declaration. The City may send written notices to Owners <br />of their failure to maintain, repair, restore and/or rebuild such Owner's Unit in accordance with <br />this Declaration. The City shall concurrently send a copy of all such notices to the Association. <br />The Owner shall cure the deficiency specified in the City's notice within thirty (30) days after the <br />date such notice is received from the City, or if such deficiency cannot reasonably be cured <br />within such thirty (30) day period, the Owner shall commence to cure such deficiency within <br />such thirty (30) day period and diligently pursue the completion of such cure as soon as <br />practicable thereafter. In the event that the Owner fails to cure the deficiency within such time, <br />the City shall have the right to maintain, repair, restore and/or rebuild the same, or caused same <br />to be done. The City shall also have the right to assess the reasonable costs thereof, exclusive of <br />administrative and internal charges, upon the Owner whose structure was so maintained, <br />EXHIBIT E: Wage 20 of 24 <br />
