X. GENERAL PROVISIONS <br />101. Effective Date; Term. But for the affordability covenant contained in Section <br />3.1 hereof, the terms and provisions of this Declaration shall take effect upon the recordation <br />hereof in the Official Records of Orange County, California, provided, however, that this <br />Declaration shall not be so recorded until the Owners of at least Ninety Percent (90%) of the <br />Parcels within the Project have executed this Declaration. Once recorded, this Declaration shall <br />remain in full force and effect for a period of twenty (20) years thereafter, and shall be <br />automatically renewed and extended thereafter for successive periods of ten (10) years each <br />unless sooner terminated by the Owners pursuant to the provisions of Section 10.2 hereof. <br />10.2 Amendments. Except as otherwise provided in Section 9.3 hereof, this <br />Declaration may be amended, modified or terminated at any time by a declaration in writing, <br />executed and acknowledged by the Owners of a majority of the Parcels in the Project. This <br />Declaration shall not be otherwise amended, modified or terminated during the term hereof. <br />10.3. Annexation Property. Any of the Annexation Parcels which are described in the <br />Legal Description of Annexation Parcels, which is attached hereto as Exhibit "C" and <br />incorporated herein, may be annexed from time to time to this Declaration by the recordation in <br />the official records of Orange County, California of a notice thereof executed by the Owner of <br />such Annexation Parcel and an officer of the Association. <br />10.4 Governing Law. This Declaration shall be construed in accordance with the laws <br />of the State of California. <br />10.5 Section Headings. The Article headings of this Declaration are for convenience <br />only and shall in no way define or limit the scope or content of this Declaration and shall not be <br />considered in any constriction or interpretation of this Declaration or any part thereof. <br />10.6 Not a Partnership. Nothing in this Declaration shall be construed to make any of <br />the Owners partners or joint venturers. <br />10.7 Binding on Successors and Assigns. This Declaration shall be binding upon and <br />inure to the benefit of the successors and assigns of Owners. Each Owner shall take all <br />reasonable steps necessary to ensure that any successor or assignee has knowledge of all terms <br />and conditions of this Declaration. <br />10.8 Attorneys' Fees. rn the event action is instituted to enforce any of the provisions <br />of this Declaration, the prevailing party in such action shall be entitled to recover from the other <br />party thereto, as part of the judgment, reasonable attorney's fees and costs. <br />EXHIBIT E: Page 23 of 24 <br />
