]EXHIBIT R: Facade & Courtyard Improvement Contract <br />FACADE AND COURTYARD IMPROVEMENT CONTRACT <br />THIS CONTRACT, made and entered into this day of <br />20 by and between: <br />hereinafter referred to as "CONTRACTOR" and: <br />hereinafter referred to as "OWNER". <br />WITNESSETH <br />Recitals: <br />A. OWNER desires to employ a general building contractor as defined in California <br />Business and Professions Code § 7057 to perform certain work on property located at: <br />(the "Property") <br />B. CONTRACTOR represents that it is qualified to perform such work as desired by <br />OWNER. <br />C. OWNER is financing all or part of the cost of the work to be performed under this <br />Contract with proceeds of a conditional loan to OWNER from the Community Redevelopment <br />Agency of the City of Santa Ana ("Agency) made pursuant to the terms of that certain Owner <br />Pan ticipation Agreement dated between the OWNER, the Agency and the City of <br />Santa Ana ("City"). The Executive Director of the Agency, or his/her designee is the representative <br />of the Agency. <br />WHEREFORE, for and in consideration of the respective and mutual covenants <br />and promises hereinafter contained and made, and subject to all the terms and conditions hereof, <br />the parties hereto do hereby agree as follows: <br />L THE WORK <br />1. SCOPE OF WORK <br />CONTRACTOR agrees, at its sole cost and expense, to provide all supervision, technical <br />personnel, labor, materials, machinery, tools, equipment, fixtures and services for the work required <br />on the Property, in accordance with the attached bid and proposal, general conditions, work write - <br />tips, specifications, and drawings, which documents are incorporated herein by reference as though <br />fully set forth. <br />CONTRACTOR shall perform all work in conformance with applicable laws and local <br />requirements whether or not covered by the specifications and drawings for the work. <br />Exhibit "R" 1 <br />
