amount: forty dollars ($40.00) per calendar day. The amount of liquidated damages shall be <br />deducted from the CONTRACTOR'S Retention Payment at project completion. If at any time the <br />amount of liquidated damages exceed the amount of Retention Payment, there shall not be any <br />payment to the CONTRACTOR until such time that the amount of payment due the <br />CONTRACTOR exceeds the amount of liquidated damages. <br />V. GENERAL <br />20. ASSIGNMENTS <br />CONTRACTOR shall not assign any rights under this Contract except upon prior written <br />authorization of OWNER and the Agency. Any request for assignment must be addressed to the <br />Agency and written consent of the Agency must be obtained prior to CONTRACTOR obtaining <br />written consent of OWNER. CONTRACTOR shall not delegate any authority or responsibility that <br />would in any way purport to relieve him of any obligation imposed by this Contract. <br />21. NONDISCRIMINATION EQUAL OPPORTUNITY AND FAIR HOUSING <br />During the performance of this Contract CONTRACTOR agrees to comply with the <br />provisions of Exhibit B of this Contract, pertaining to nondiscrimination, equal opportunity and fair <br />housing and employment. <br />22. CONFLICT OF INTEREST <br />No person who is an employee, agent, consultant, officer or elected official or appointed <br />official of the Agency, who exercises or has exercised any fiinctions or responsibilities with respect <br />to activities assisted. with HOME funds or who are in a position to participate in a decision making <br />process or gain inside information with regard to these activities, may obtain a financial interest or <br />benefit from this Contract, or have an interest in any subcontract or contract with respect hereto, <br />either for themselves or those with whom they have family or business ties, during their temire or <br />for one year thereafter. <br />23. RESERVED <br />24. UNAVOIDABLE DELAYS AND DEFAULTS <br />The time of completion of this Contract shall be extended by the number of calendar days <br />which CONTRACTOR is prevented fiom performing work as a result of: inclement weather, acts <br />of OWNER or the Agency not contemplated by this Contract, the unavailability of workers or <br />materials due to strifes, accident, acts of God, fire, unusual delays in transportation, unavoidable <br />casualties, causes beyond CONTRACTOR'S control, or any cause that the Agency may determine <br />justifies the delay. The CONTRACTOR shall not be entitled to an extension in the number of <br />calendar days for completion, luiless, within five (5) days from the beginning of such delay, he <br />notifies the OWNER and the Agency in writing of the causes of the delay, which causes must be <br />acceptable to the Agency. <br />25. PERFORMANCE AND PAYMENT BOND <br />By signing this Contract, OWNER waives any right he may have to a performance and <br />payment bond in regard to the work performed in accordance with this Contract. <br />Exhibit "R" 6 <br />
