4.0 COPYRIGHT NOTICE The Software and the Documentation are protected by copyright and other intellectual property laws. Unauthorized copying of the Software or of the Documentation is expressly forbidden. The Licensee may be held liable for any copyright infringement that is caused or encouraged by the Licensee's failure to abide by the terms and conditions of this License. 5.0 USE RESTRICTIONS Except as otherwise provided herein, the Licensee agrees that it shall not: (a) copy the Software, except as set out in Section 1 of this License; (b) network the Software; (c) modify, enhance, reverse- engineer, decompile, disassemble, translate or convert into human readable form all or any part of the Software, or use any part of the Software to develop any derivative works or any functionally compatible, substantially similar or competitive products; (d) publish or distribute the Software; or (e) use the Software except as authorized herein. The Licensee covenants and undertakes to take all reasonable precautions to prevent third parties from using the Software in any way that would constitute a breach of this License. 6.0 TRANSFER RESTRICTIONS The Software is licensed only to the Licensee, and may not be transferred to anyone without the prior written consent of Positron. In no event may the Licensee transfer, assign, rent, lease, sell, or otherwise dispose of the Software on a temporary or permanent basis except as expressly provided herein. 7.0 TERMINATION This License is effective until terminated as hereinafter set forth. Positron may terminate this License and require the Licensee to return the Software and destroy all copies if the Licensee is in breach of any of the terms and conditions of this License.
