• <br />subcontractors, materials men, laborers and any other person, firm or corporation <br />famishing or supplying work, services, materials or supplies in connection with the <br />performance of this Agreement by the PROJECT MANAGER and from any and all <br />claims and losses accruing or resulting to any person, firm or corporation who may be <br />injured by the PROJECT MANAGER in the perfommar-ce of this Agreement. <br />18, Tnenranrp <br />The City shall provide or require that the Project Manager procure and keep in force for <br />the length of time specified in the following sections, at the contractor's own cost and <br />expense, the following policies of insurance with companies doing business in California <br />and which are acceptable to City. PROJECT MANAGER upon request shall provide <br />FRIENDS and CITY with copies of all insurance policies. The contractor shall, "pending <br />acceptance" of insurance, supply and furnish FRIENDS with certificates showing such <br />insurance policies are in force with the written undertaking of each insurer to give <br />FRIENDS thirty (30) days prior written notice of cancellation, termination or material <br />change of such insurance coverage. The insurance shall at a minimum include: <br />A. Worker's Compensation insurance as required by the laws of the State of California <br />during the term of this Agreemern. The policy may include Employees Liability <br />coverage with limits not less than $1,000,000. Each contractor and/or sub- <br />contractor shall be required to certify that he/she is aware of the provisions of section <br />3700 of the California Labor Code, which requires every employer to be insured <br />against liability for Worker's Compensation or to undertake self-insurance in <br />accordance with the provisions of that Code. Each contractor and/or sub-contractor <br />shall be required to comply with the provisions of section 3700 of the Labor Code <br />before commencing the performance of the work under this Agreement. <br />B. Commercial General Liability insurance, including but not limited to, Personal Injury, <br />Broad Form Property Damage, Contractual (as needed) Products and Completed <br />Operations or Owners and Sub-contractor Protective Liability. The policy shall <br />contain <br />a SEVERABII..ITY of interest clause or cross liability clause or the equivalent <br />thereof. The <br />policy shall be endorsed to include the following: <br />1) FRIENDS, its board members, directors, officers, agents and employees as <br />additional insureds. CITY, its officers, agents, volunteers and employees as <br />additional insureds. <br />That coverage afforded on behalf of FRIENDS and CITY shall be primary <br />insurance and any other insurance available to FRIENDS and CITY under any <br />other policies shall be excess over the insurance required hereby. <br />2) Limits of liability: <br />Bodily Injury - $1,000,000 minimum <br />Property Damage - $500,000 minimum <br />4 <br />
