DRAFT <br />Security Income (SSI), welfare, disability, or pension payments; and (iv) alimony or child support. <br />To verify income, Developer shall comply with the procedures set forth in Section A-3 of the <br />Administrative Procedures Manual. Subject to the foregoing preferences, Developer shall consider <br />Gross Household Income from all adult Household members, which is anticipated to be received <br />during the 12-month period following the date of the determination of Gross Household Income. <br />Within fifteen (15) days of delivery of an executed contract for purchase of an Affordable Unit by <br />a prospective Homebuyer, Developer shall provide City with the Income Verification Form set <br />forth in Exhibit F and the Certification of Continuing Occupancy set forth in Exhibit G. <br />4.9 Occupancy Requirements. The Owner shall occupy and continually use the <br />Affordable Unit as the Homebuyer's Primary Residence during the Total Affordability Tenn. On <br />an annual basis, the Program Manager will send the Homebuyer an Occupancy Recertification <br />Form to be filled out and returned to the City within thirty (30) days of receipt. The Owner shall <br />affirm that they are occupying the Affordable Unit as their Primary Residence. The Owner will be <br />required to submit copies of two current utility bills, or other evidence of occupancy that is <br />acceptable to the City, as part of the annual recertification process. <br />4.10 Emergency Evacuation Plan. Developer shall submit and obtain approval of an <br />Emergency Evacuation Plan (the EEP) from City Police and Fire Protection agencies prior to <br />issuance of a Certificate of Occupancy. Up-to-date 24-hour emergency contact information for <br />the on -site personnel shall be provided to the City on an ongoing basis and the approved EEP shall <br />be kept onsite and also be submitted to the following City Agencies: <br />(a) Police Department <br />(b) Fire Department <br />(c) Planning and Building Agency <br />(d) Community Development Agency <br />4.11 INTENTIONALLY DELETED <br />4.12 INTENTIONALLY DELETED <br />4.13 Marketing and Resident Selection Plan. <br />4.13.1 Prior to Certificate of Occupancy, Developer shall prepare and obtain City's <br />approval of a marketing program and resident selection plan for the sale of the Affordable Units <br />at the Project ("Marketing Program"). The sale of the Affordable Units shall thereafter be <br />marketed in accordance with the Marketing Program as the same may be amended from time to <br />time with City's prior written approval. Upon request, Developer shall provide City with periodic <br />reports with respect to the sale of the Affordable Units, <br />4.13.2 The Marketing Program shall include, but is not limited to, marketing and <br />community outreach activities, proposed homebuyer selection criteria, occupancy standards, <br />income requirements, timeline and details for outreach and marketing, data collection, record <br />keeping and monitoring, procedures for complaints, and compliance assessment.
