<br />INSURANCE ON FILE N-2007-140-01 <br />v^JORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />3 15 -o`i <br />CLERK OF COUNCIL FIRST AMENDMENT TO <br />DATE: 9-.~3-U8 <br />RESTATED LEASE AGREEMENT <br />O:P~rksx RP~.(~-~ <br />Cyr ~ w~( THIS FIRST AMENDMENT TO LEASE AGREEMENT is entered into on September <br />15, 2008, by and between REBUILDING TOGETHER ORANGE COUNTY ("Tenant"), <br />and the City of Santa Ana, ("Landlord"). <br />RECITALS: <br />A. The parties entered into that certain Restated Lease Agreement #N-2007-140, dated <br />November 21, 2007, (hereinafter "said Lease Agreement") by which Tenant has <br />leased space within the building known as Cypress Senior Center, 625 S. Cypress St. <br />in the City of Santa Ana. <br />B. In accordance with the terms and conditions of said Lease Agreement, the parties wish <br />to amend the extend the term of the lease and increase the monthly rental fee. <br />WHEREFORE, in considerafion of the covenants contained in said Lease Agreement, and <br />subject to all the temps and conditions of said Lease Agreement, except those amended in <br />this Fast Amendment to Lease Agreement, the parties agree as follows: <br />1. Section 2, TERM OF LEASE, shall be deleted in its entirety and replaced with the <br />following: <br />"The initial term of this Lease shall be one year, commencing on October 1, 2007 <br />and continuing through September 30, 2008. A subsequent two-year term shall <br />commence on October 1, 2008 and continue through September 30, 2010. The <br />parties may extend the term of this Lease by mutual agreement evidenced by a <br />writing executed by both parties." <br />2. Section 3, RENT, shall be amended to increase the monthly rent to $715.00. Said section <br />shall read,rn full, as follows: <br />"During the initial one year term of this Lease Agreement, Tenant agrees to pay <br />Landlord as rental, the sum of Five Hundred Fifty Dollars ($550.00). During the <br />subsequent two-year teen, commencing October 1, 2008, Tenant shall pay Landlord <br />a monthly rental fee of Seven Hundred Fifteen Dollars ($715.00), on or before the <br />fifth day of each calendar month during the term of this Lease. Rent for any period <br />during the extended rental term which is less than one (1) month, shall be a prorated <br />portion of the monthly installment based upon a thirty (30) day month." <br />3. Except as hereinabove amended, all terms and conditions of said Lease Agreement shall <br />remain in full force and effect. <br />// <br />// <br />
