Page 1 of 41 <br />LANDSCAPE MAINTENANCE CONTRACT <br />SPECIAL PROVISIONS <br />DEFINITIONS <br />The use of the word "Director' shall be construed to mean the Executive Director of <br />Parks, Recreation & Community Services or their designated representative(s). The <br />use of the word "Contractor" shall be held to mean the Contractor and/or any person <br />employed by him and working under this contract. <br />The use of the word "pruning" shall include the practices sometimes referred to as <br />"trimming". <br />The use of the word "weed" shall be understood to mean any undesirable or misplaced <br />plant. <br />2. PERIOD OF AGREEMENT <br />The contractor shall perform afl work under this contract over a period of twelve (12) <br />months, subject to extension or termination as described below. <br />3. BID REQUIREMENT <br />Prior to contract award, any bidder may be required at any time to demonstrate to the <br />Director that he can successfully perform maintenance work of the type involved in this <br />contract and that he possesses suitable equipment to perform the work. <br />4. BONDS <br />Each bid must be accompanied by cash, a cashier's or certified check payable to the <br />City of Santa Ana, or a bid bond, for an amount not less than ten percent (10%) of the <br />aggregate of the bid, as a guarantee that the bidder will enter into the proposed contract <br />if the same is rewarded to him. Any bid submitted without any of the above shall not be <br />considered. <br />The successful bidder will be required to obtain and submit to the City two surety bonds. <br />These bonds are: <br />1. "Payment Bond" for not less than 100 percent of the contract price. <br />2. "Faithful Performance Bond" for not less than 100 percent of the contract price <br />25H-15 <br />
