bk: 1 /27/09 <br />RESOLUTION NO. 2009-XXX <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA CERTIFYING THE ENVIRONMENTAL <br />IMPACT REPORT FOR THE SKY LOFTS PROJECT, <br />APPROVING A MITIGATION MONITORING PROGRAM, <br />AND ADOPTING CERTAIN FACTS, FINDINGS AND A <br />STATEMENT OF OVERRIDING CONSIDERATIONS <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. The City has under consideration application to construct Sky Lofts, the <br />final portion of the City Place Development located at 301 East Jeanette <br />Lane. The Sky Lofts proposed project consists of a high rise tower, <br />stacked townhomes and a parking structure on an approximately two acre <br />site. The residential segment will provide 333 condominium units within <br />the tower and 20 stacked for-sale townhouses wrapping one-side of the <br />729-space parking garage. <br />1. As a result of public input, the City prepared a Draft EIR <br />(Environmental Impact Report) for this proposed project, which was <br />submitted for public comment to all responsible agencies, the State <br />Clearinghouse, neighboring communities and districts, <br />neighborhoods in the vicinity and the requesting public. <br />2. All comments to the Draft EIR were considered and responded to in <br />the proposed Final EIR (which includes the Draft EIR and errata). <br />3. A proposed mitigation monitoring plan has been prepared, as has <br />the facts, findings and statements which are attached to this <br />Resolution. <br />B. At its regular meeting of January 12, 2009, the Planning Commission of <br />the City of Santa Ana, following a duly noticed public hearing, <br />recommended to the City Council that it adopt this Final EIR, the <br />mitigation monitoring plan, and certain facts, findings and statements. <br />75A-108 <br />
