(Ord. No. NS-1922, § 1, 7-20-87; Ord. No. NS-2841, § 5, 2-4-13) <br />Sec. 21-45. Collector; authority to suspend and revoke licenses. <br />The collector shall have the authority and duty to suspend or revoke any license granted or issued under the <br />provisions of this Chapter at any time for any of the following: <br />(a) A material false statement contained in the application for a new license or in the application for a <br />renewal license granted or issued under the provisions of this Chapter, or in any affidavit or statement <br />required to be filed under the provisions of this Chapter, or <br />(b) Upon the determination that the licensee has not paid the tax required to be paid as a condition for <br />the issuance of the license, pursuant to the procedures set forth in Section 21-86. <br />Any person transacting and carrying on any business during any period of license suspension shall be <br />deemed to be doing so under an invalid license. Any person transacting and carrying on business during any period <br />of license revocation shall be deemed to be doing so without a license. Provided further, that any person <br />transacting and carrying on business during any period of license revocation or suspension shall be refused any <br />permits or entitlements of use the issuance of which requires the production of a valid unexpired business license. <br />(Ord. Collector; authority to issue citations. <br />The collector, as chief revenue officer, and each and every duly authorized revenue officer of the city have <br />the duty to enforce this Chapter and are authorized to arrest persons without a warrant whenever they have <br />reasonable cause to believe that the person to be arrested has committed a violation of said provisions in their <br />presence. In any case in which a person is arrested pursuant to this section and the person arrested does not <br />demand to be taken before a magistrate, said officer making the arrest shall prepare a written notice to appear <br />and release the person on his or her promise to appear as prescribed by Chapter 5C Title III of Part 2 of the Penal <br />Code of the State of California (commencing with Section 853.6). <br />(Ord. No. NS-1922, § 1, 7-20-87) <br />ARTICLE IV. EXEMPTIONS <br />Sec. 21-47. Conflicts with federal or state law. <br />Nothing in this Chapter shall be deemed or construed to apply to any person transacting or carrying on any <br />business exempt from business license taxes by virtue of the constitution or applicable statutes of the United <br />States or the state. <br />(Ord. Business licensing —Specified exemptions. <br />(a) A business license shall not be required for the conducting of any entertainment, concert, exhibition or <br />lecture on scientific, historical, literary, religious or moral subjects whenever the receipts of any such activity <br />are to be appropriated to any church or school or to any religious or benevolent purpose within the city. <br />City of Santa Ana RFP No. 23-165 Page 91 of 196 <br />
