INSURANCE NJT C!~ F <br />WORK MAY ~Q~ PE~,:CL.Fi-~ <br />CLERK OF !~C~UNCIL THIRD AiVIENDMENT TO AGREEIVIENT <br />SATE: MAR 1 5 2009 <br />THIS THIRD AMENDMENT TO AGREEMENT is entered into on April 1, 2009, by and <br />~, between San Joaquin Chemical Inc, a California corporation ("Consultant") and the City of Santa Ana, a <br />charter city and municipal corporation of the State of California ("City"). <br />`~ <br />~~ <br />O <br />'N~ <br />~~ <br />RECITALS: <br />A. The parties entered into Agreement #N-2007-096, dated August 13, 2007, (hereinafter."said <br />Agreement") by which Consultant has provided water treatment services for City's Police facilities. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to add compensation <br />to provide for the uninterrupted provision of services. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all the terms <br />and conditions of said Agreement, except those amended in this Third Amendment to Agreement, the <br />parties agree as follows: <br />1. Section 2.a, COMPENSATION, shall be deleted in its entirety and replaced with the following: <br />"City agrees to pay, and Contractor agrees to accept as total payment for its services, the rates and <br />chazges identified in Exhibit A. The total sum to be expended under this Agreement, shall not exceed <br />$25,000.00, per fiscal year, during the term of this Agreement." <br />2. Section 3, TERM, shall be amended to extend the termination date through June 30, 2010. <br />3. Except as hereinabove amended, all terms and conditions of said Agreement shall remain in full force <br />and effect. <br />WITNESS WHEREOF, the parties hereto have executed this Third Amendment to Agreement on the date <br />and year first written above. <br />ATTEST: <br />~ PATRICIA E.
