DO NOT RECORD <br />purposes to which it presently is and may, at the option of Landlord, be <br />devoted. <br />(c) Tenant hereby acknowledges that title to the Property is vested in <br />Landlord and agrees never to assail or resist the same, and further agrees <br />that Tenant's use and occupancy of Property shall be referable solely to <br />the permission herein given. <br />(d) Upon the expiration or termination of this Agreement, Tenant shall <br />surrender Property to Landlord in good and clean condition, less ordinary <br />wear and tear. <br />(e) As a covenant to this Agreement, Tenant shall adhere to and comply with <br />all responsibilities enumerated in Rider 1, attached hereto and <br />incorporated herein. Failure to comply with said responsibilities shall <br />constitute good reason for termination of this Agreement by Landlord. <br />Section 1.02 Term <br />(a) The term of the Agreement for renting the Property ("Term") shall <br />commence on July 1, 2009 ("Commencement Date") and shall continue <br />on as a month -to month tenancy. <br />(b) Notice of intent to vacate or termination of the landlord -tenant relationship <br />is only valid with thirty (30) days prior written notice to the other party. <br />Section 1.03 Rent. <br />(a) Upon the Commencement Date, Tenant shall pay to Landlord monthly rent in the <br />amount of $932.00 per month ("Compensation") for use of the Property. Compensation <br />will be due upon execution of this Agreement and thereafter on or before the 5th of each <br />month, payable to "The City of Santa Ana" and remitted to: The City of Santa Ana at <br />City Hall (6th Floor), 20 Civic Center Plaza (M-25) Santa Ana, CA 92701. A late charge <br />of ten percent (10%) shall be applied after any payment hereunder is due but unpaid. <br />(b) Tenant's monthly rental payments shall be subject to a CPI adjustment annually <br />on the anniversary of the Commencement Date during the term hereof. <br />Section 1.04 Non -Possessory Interest <br />Landlord retains full possession of the Premises and Tenant will not acquire any interest <br />temporary, permanent, irrevocable, possessory or otherwise by reason of this Agreement, <br />or by the exercise of the permission given herein. Tenant will make no claim to any such <br />interest. Any violation of this provision will immediately void and terminate this <br />Agreement. <br />
