DISTRICT AGREEMENT <br />12-522 <br />RECITALS <br />1. STATE and CITY, pursuant to Streets and Highways Code sections 114 and 130, are <br />authorized to enter into a Cooperative Agreement for improvements to State <br />Highways within CITY's jurisdiction. <br />2. CITY intends to construct a new Alton Over Crossing and HOV direct access drop <br />ramps on State Route 55 (SR-55) at Alton Avenue, referred to herein as "PROJECT". <br />3. CITY intends to prepare Plans, Specifications and Estimates (PS&E) and perform <br />right of way (R/W) activities, collectively referred to herein as "WORK", and is <br />willing to fund one hundred percent (100%) of all capital outlay and staffing costs <br />related to the PROJECT PS&E and R/W activities, except for the costs of STATE's <br />Independent Quality Assurance (IQA) of WORK performed by or for CITY. <br />4. Delivery of the Project Report (PR) and Environmental Document (ED) were covered <br />in a prior Cooperative Agreement executed by STATE and CITY on October 17, <br />2005 (District Agreement No. 12-214). <br />5. PROJECT construction will be the subject of a separate future cooperative agreement <br />6. With the exception of STATE's IQA, STATE funds will not be used to finance any of <br />the capital and support costs for PROJECT. <br />7. In case of inconsistencies, this Agreement supersedes any prior Memorandum of <br />Understanding (MOU) relating to PROJECT. <br />8. The parties now define herein below the terms and conditions under which PROJECT <br />is to be designed, R/W activities performed, and financed. <br />SECTION I <br />CITY AGREES: <br />1. With the exception of STATE's IQA, to fund one hundred percent (100%) of all <br />WORK costs. <br />2. To not use STATE funds for any PROJECT capital and support costs except as set <br />forth in this Agreement. <br />3. To perform or have performed PS&E and R/W engineering and acquisition services <br />in accordance with all State and Federal laws, regulations, policies and procedures <br />and standards that STATE would normally follow. All such work shall be submitted <br />to STATE for STATE's review, comment, and concurrence at appropriate stages of <br />development. <br />
