bk:7/22/09 <br />RESOLUTION NO. 2009- <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA APPROVING APPEAL NO. 2009-04 AND <br />GRANTING CONDITIONAL USE PERMIT NO. 2006-20 AS <br />CONDITIONED TO ALLOW A PARKING LOT AND <br />VARIANCE NOS. 2006-13A AND 2006-13B AS <br />CONDITIONED TO ALLOW A REDUCTION IN <br />LANDSCAPING FOR THE PROPERTY LOCATED AT 202 <br />EAST SEVENTEENTH STREET <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS <br />FOLLOWS: <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and declares as follows: <br />A. Applicant is requesting approval of a conditional use permit to operate a <br />surface parking lot and two variances to reduce the required landscaping for <br />the property located at 202 East Seventeenth Street. <br />B. Conditional Use Permit No. 2006-20, and Variance Nos. 2006-13a and <br />2006-13b ("the matter") came before the Planning Commission of the City <br />of Santa Ana for a duly noticed public hearing on May 11, 2009. On that <br />date consideration of the matter was continued to June 8, and again on <br />June 8 to June 22. No meeting was held on June 22, so the matter was <br />duly renoticed for a public hearing on July 27, 2009, and at that time <br />continued by vote of the Commission to September 14, 2009. <br />C. At that place and time, following the public hearing the Planning <br />Commission granted the application, but with a condition with respect to <br />adding trees to the interior of the parking lot to which applicant objected. <br />This appeal followed. <br />D. In lieu of the interior trees condition imposed by the Planning Commission, <br />the applicant has agreed to plant the same number of queen palm trees <br />within a newly created landscape planter to be located at the northwest <br />corner of the site. Staff supports this request provided that the trees are <br />eight foot (8') brown trunk trees, which will translate into approximately <br />twelve foot (12') tall palm trees. Staff believes this would result in the <br />establishment of a significant landscape element along a major <br />thoroughfare and will serve as a visual gateway to several city <br />neighborhoods. <br />Resolution No. 2009- <br />Page 1 of 10 <br />75D-13 <br />
