reports (along with the "Statement of Compliance") and basic records are <br />required to be maintained and submitted, or made available, pursuant to 29 <br />C.F.R. §5.5(a)(3). No payment, advance, grant, loan or guarantee of funds shall <br />be approved by the federal agency unless there is on file with the agency a <br />certification by the contractor that the contractor and its subcontractors have <br />complied with the provisions of 29 C.F.R. §5.5. A breach of the contract <br />clauses in 29 C.F.R. §5.5 may be grounds for termination of the contract, and <br />for debarment as a contractor/subcontractor, as provided in 29 C.F.R. §5.12. <br />Labor standards interviews/investigations shall be made as necessary to assure <br />compliance [29 C.F.R. §5.6(a)(3)]. <br />Reporting Requirement: CONTRACTOR shall furnish City with all records <br />indicating whether contractors and subcontractors employed on this project are in <br />compliance with the Davis-Bacon Act. Such records shall include without <br />limitation: Federal and State wage determinations, documentation of state <br />contractor license status, documentation of federal debarment status, and certified <br />payroll records. Such records shall be famished to the City not less than fifteen <br />(15) days following the period to which such records are applicable. <br />5. Site Visits <br />City and Contractor shall provide reasonable access to facilities at reasonable <br />times, to allow Department of Energy personnel to make site visits to review <br />project accomplishments and management control systems and to provide <br />technical assistance, if required. <br />C. Estimate of Savings to be Achieved by FIM's <br />The contractor has estimated energy savings for the various measures included in <br />this project using industry standard engineering analysis tools. The results of these <br />analyses are provided in Exhibits C and E, summarized in Table 1, below. The <br />City acknowledges that the savings calculations are estimates and Contractor does <br />not guarantee the savings.
