INSURANCE NOT REQUIRED <br />WORK MAY PROCEED <br />CLERK OF COUNCIL <br />j1?TF NOV 2 4 2009 <br /> <br />n_N <br />V7?? <br />E <br />N 2 <br />-- 3 <br />v ?- <br />FIRST AMENDMENT TO AGREEMENT <br />A-2009-168 <br />THIS FIRST AMENDMENT TO AGREEMENT is entered into on October 5, <br />2009, by and between Johnson-Frank and Associates, Inc., a California corporation <br />("Consultant') and the City of Santa Ana, a charter city and municipal corporation of the <br />State of California ("City"). <br />RECITALS <br />A. The parties entered into Consultant Agreement A-2008-086, dated May 5, 2008, <br />(hereinafter "said Agreement") by which Consultant has provided aerial mapping and <br />digital surveying services. <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to <br />increase compensation to pay for additional mapping and surveying services. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and <br />subject to all the terms and conditions of said Agreement, except those amended in this <br />First Amendment to Agreement, the parties agree as follows: <br />1. Section 3, COMPENSATION, shall be amended to increase compensation by <br />$200,000 for a total not to exceed amount of $500,000.00. <br />2. Except as herein amended, all terms and conditions of said Agreement shall remain in <br />full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this First Amendment to <br />Agreement on the date and year first written above. <br />ATTEST: <br />MARIA D.
