("Contractor"). <br />('~ ~1 i 2~ <br />RECITALS <br />A. The City and Contractor entered into Agreement n-2007-096, dated August 13, 2007, <br />(hereinafter "said Agreement"), by which Contractor has provided water treatment <br />services to the City. <br />B. Said Agreement was amended on July, 1, 2008, February 15, 2009 and again on April 1, <br />2009, to extend the term and add compensation. <br />C. The parties now desire to again amend said Agreement to authorize water treatment <br />services for the Grand Central Art Center. <br />WHEREFORE, in consideration of the mutual and respective promises hereinafter <br />contained and made, and subject to all the terms and conditions of said Agreement as hereby <br />amended, the parties do hereby agree as follows: <br />1. Section 1, SCOPEOF SERVICES, shall be deleted in its entirety and replaced with the <br />following: <br />"Contractor shall provide water treatment services for the Santa Ana Police Department and <br />Detention Facility as set forth in Exhibit A to said Agreement. Additionally, Contractor will <br />clean the evaporative condenser at the Grand Central Art Center, and provide monthly water <br />treatment services for the Grand Central Art Center, as set forth in Exhibit B-1 and B-2, <br />respectively, attached hereto and incorporated by reference. <br />2. Except as modified herein, the terms and conditions of said Agreement remain unchanged <br />and in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this Fourth Amendment to said <br />Agreement on the date and year first above written. <br />ATTEST: <br />MARIA D.
