It is understood and agreed by the parties <br />hereto that all right, title, and interest ir. and to the ownership <br />of said real property improvements and fixtures shall, upon their <br />completion and subject only to the teams of this Agreement, be- <br />come vested in RIVER VIEW, and RIVER VIEti~1 shall thereafter be <br />deemed the sole owner of said improvements. CONCESSIODTAIRE fur- <br />then agrees that, at its sole expense, it shall install in said <br />restaurant facility, trade fixtures and equipment as described in <br />Exhibit "B" attached hereto and incorporated by reference herein. <br />Subject to the provisions hereof, all right, title and interest in <br />and to said trade fixtures and equipment shall remain vested in <br />COr1CESSIONAIP.E subject to the terms of this Agreement and the <br />security interest granted RIVER VIE:~T hereunder and as more fully <br />described hereinafter. <br />CONCESSIO"3AIRE agrees that at its sole expense (which <br />shall be reimbursed from rental payments due ar_d owing RIVER <br />VTE~~T as hexeinabove set forth and as provided hereinbelow), it <br />will undertake to construct real property improvements, including <br />real property fixtures, consisting of a "half-way .house" to be <br />situated on the golf course as agreed to by both parties, to be <br />completed and operatior_al on or bafore May 1, 1975. The plan, <br />design, construction costs, and location of said "half-way house" <br />shall be satisfactory to RIVER VIEb~T, and each and all of same <br />shall require the written approval of RIVER VIE4~7 prior to the com- <br />mencemer_t of construction. CONCESSIO^7ATRE agrees to supply appro- <br />priate contract docu_ner_ts, books of account, and other records to <br />-5- <br />
