Any facilities so installed shall, insofar as practicable, <br />be designed and constructed in a manner which will minimize the <br />detrimental effect upon business activities and irprovements <br />within the Leased Land. <br />LESSOR reserves the right to park vehicles and to permit the park- <br />ing of vehicles on. the westerly Santa Ana River levee from Garden <br />Grove Boulevard south for a distance of 900 feet and from Garden <br />Grove Boulevard north for-500 feet throughout the period LESSOR <br />retains a maintenance yard fronting on the south side of Garden <br />Grove~Boulevard. <br />LESSOR reserves the right to enter upon and travel over any and <br />every part of the Leased Land for any purpose connected with <br />the conduct of its business. LESSOR shall exercise this right <br />reasonably and without caprice. <br />It is agreed that LESSEE in the design of facilities to be constructed <br />within the Leased Land shall provide an adequate and acceptable <br />route for vehicular travel through and across the Leased Land for <br />the use of LESSOR and others associated with LESSOR in any phase <br />of flood control or water conservation work for the movement of <br />equipment and personnel along Santa Ana River and Santiago Creek. <br />LESSOR shall use such route in the regular conduct of its business <br />but shall not be limited thereto in any situation or at any time <br />the Chief Engineer deems it necessary to travel over any other <br />portion of the Leased Land. <br />An adequate and safe equestrian trail shall be continuously main- <br />tained through and across the Leased Land by LESSEE. The location, <br />width, and condition of said trail shall be subject to the prior <br />approval of the Chief Engineer, who shall consult with the Associ- <br />ated Riding Clubs of Orange County prior to granting approval. <br />10. INSPECTION BY LESSOR (4.8gN) <br />LESSOR shall have the right at any time and from time to time to <br />enter upon the Leased Land and upon the Joint Leasehold for <br />inspection purposes in connection with administering this Lease <br />and as an aid in determining whether LESSEE is adequately fulfilling <br />the terms, covenants and conditions hereof. This right shall be <br />exercised reasonably and shall not be used as a means of harassing <br />LESSEE. <br />11. ACCOUNTING YEAR (5.19x1) <br />Any reference to "Accounting Year" in this Lease shall mean the ~r <br />period from the first day of December of one year to the last ~ <br />day of r~ovember of the succeeding year (being LESSEE'S fiscal ~y>?~ <br />year); except, the first Acccounting Xear shall be the period <br />from the beginning of the Operating Period until the following <br />rlovember 30, and the last Accounting Year shall be the period <br />from.December 1, 1985, to August 20, 1986. If the lease is <br />renewed under the provisions of Clause 27 (OPTION TO REiiEtd), <br />the period from August 21, 1}86, to November 30, 1985, shall <br />~~so-~s fI - 8- <br />
