18.3. Nan-Disclosure Agreement. Priox• to any approved disclosure of Confidential <br />Customer Information, SCE may require the City to enter into a nondisclosuz•e <br />agreement. <br />18.4. Commission Proceedings. This provision does not prohibit the City from <br />disclosing non-confidential information concerning the Authorized Worl{ to the <br />Commission in any Commission proceeding, or any Commission-sanctioned meeting <br />or proceeding or other public forum. <br />18.5. Return of Confidential Information. Confidential Customer Information <br />(including all copies, backups and abstracts thereof) provided to the City by SCE, <br />and any and all documents and materials containing such Confidential Customer <br />Information oz• produced by the City based on such Confidential Customer <br />Information (including all copies, backups and abstracts thereof), during the <br />performance of this Agreement shall be returned upon written request by SCE. <br />1$.6. Remedies. The Parties acknowledge that Confidential Customer Information <br />is valuable and unique, and that damages would be an inadequate remedy for <br />breach of this Section 18 and the obligations of the Parties are specifically <br />enforceable. Accordingly, the Parties agree that in the event of a breach or <br />threatened breach of this Section 18 by the City, SCE shall be entitled to seek and <br />obtain an injunction preventing such breach, without the necessity of px•oving <br />damages or posting any bond. Any such relief shall be in addition to, and not in lieu <br />of, money damages or any other available legal or equitable remedy. <br />ENERGY LEADER PARTNERSHIP PROGRAM AGREEMENT ~g <br />
