C)N wllk. <br />`NORK MAY PROCEED <br />UNTIL INSURANCE FX'~'IRES <br />CLER~OUNCIL <br />nnTE `3,~- l ~ Contract No. <br />A-2010-025 <br />_~ <br />d~ <br />J `~ <br />t~ ~ <br />~~ ~ <br />~1;,J <br />AGREEMENT UNDER THE WORKFORCE INVESTMENT ACT <br />(AMERICAN RECOVERY AND REINVESTMENT ACT OF 2009) <br />THIS AGREEMENT, made and entered into this 16th day of February, 2010, by and <br />between the City of Santa Ana, a charter city and municipal corporation duly organized and existing <br />under the Constitution and laws of the State of California ("CITY") and Hispanic Business Consultants <br />("CONTRACTOR") effective as of February 1, 2010. <br />W-I-T-N-E-S-S-E-T-H <br />Recitals: <br />A. CITY has been designated a Local Workforce Investment Area (LWIA) under <br />the Workforce Investment Act of 1998, Public Law 105-220 ("the Act"). <br />B. The State of California has created the LWIA to administer the Act programs <br />operated by the State of California pursuant to the Act. <br />C. As a LWIA, CITY is entitled to receive federal funds to establish programs to <br />increase training opportunities for unemployed individuals and also to preserve and create jobs. One <br />goal of California's Workforce Investment System is to provide the opportunities to achieve career <br />goals that will allow individuals to successfully compete in the labor market and prepare them for <br />higher education. <br />D. The American Recovery and Reinvestment Act of 2009 (the "Recovery Act") <br />includes provisions for WIA Adult and Dislocated Worker funds, WIA Youth funds including summer <br />youth employment activities, and Wagner-Peyser Act funds for reemployment services. <br />E. CONTRACTOR has experience in offering education, occupational <br />development, business training, lay-off aversion and employment programs for the labor market <br />participants in the City of Santa Ana ("said program"). <br />F. CONTRACTOR is willing to operate said program pursuant to the Act and <br />California law. <br />WHEREFORE, for and in consideration of the respective and mutual covenants and <br />promises hereinafter contained and made, and subject to all the terms and conditions hereof, the parties <br />hereto do hereby agree as follows: <br />I. <br />CONTRACTOR'S OBLIGATIONS <br />A. CONTRACTOR agrees to provide the following services pursuant to said <br />program, as more specifically set forth in CONTRACTOR'S program narrative contained in "Exhibit <br />Page 1 of 15 <br />
