Complaints on the basis of handicap must be filed within 180 days of the alleged <br />occurrence. These complaints must be filed directly with the WIA administrative <br />entity. The WIA administrative entity shall issue a written decision within 30 days <br />of the filing of the complaint. If the complaint is still unresolved, an appeal may be <br />made to the Chief of State Workforce Investment Division Office. <br />The Department of Labor, the Civil Service Commission, the Equal Employment <br />opportunity Commission, and many other offices and agencies are committed to <br />assuring equal employment opportunities for all persons. Criminal Complaints <br />In accordance with the WIA (P.L. 105-200) and the implementing code of Federal section <br />667.600.... Federal handling of criminal complaints and report fraud, abuse and other <br />criminal activity. "All information and complaints involving fraud, abuse or other criminal <br />activity shall be reported directly and immediately to the City of Santa Ana and the <br />Secretary of Labor." <br />II. General Procedures for Handling Non-Criminal Violations of the <br />Act <br />The following procedure is promulgated to meet the requirements of Title 20, of the Code of <br />Federal Regulations, Section 667.600 through 667.640 of the WIA regulations, and Section <br />181 (c) of the Act (Public Law 105.200: 29 U.S. Code Sec. 2931 et seq.) at the State and LWIA <br />level for the receipt, investigation, hearing, and resolution of complaints by WIA participants, <br />sub recipients, applicants for participation, or financial assistance, labor unions, community <br />based organizations, or any other persons. <br />These procedures provide for resolution of non-criminal complaints arising from the operation of <br />the Santa Ana LWIA. <br />6 <br />EXHIBIT C <br />~~ <br />
