INSURANCE ON FILE A-2008-070-001 <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXXPIIR <br />7-k- - <br />CLERK OF COUNCILII <br />n?TF.: ?-21-???V <br />FIRST AMENDMENT TO AGREEMENT <br />THIS FIRST AMENDMENT TO AGREEMENT is entered into on March 16, 2010, by <br />and between Johnson-Frank & Associates, Inc., a California corporation ("Consultant") and the <br />City of Santa Ana, a charter city and municipal corporation of the State of California ("City"). <br />RECITALS <br />A. The parties entered into Consultant Agreement A-2008-070, dated April 7, 2008, (hereinafter <br />"said Agreement") by which Consultant has provided construction surveying services <br />B. In accordance with the terms and conditions of said Agreement, the parties wish to extend the <br />term of said Agreement and increase compensation to pay for services during the extended <br />term. <br />WHEREFORE, in consideration of the covenants contained in said Agreement, and subject to all <br />the terms and conditions of said Agreement, except those amended in this First Amendment to <br />Agreement, the parties agree as follows: <br />I . Pursuant to Section 3, TERM, the City hereby exercises its option to renew the terms and <br />conditions of said Agreement for an additional one year period. <br />2. Pursuant to Section 2, COMPENSATION, an additional $240,000 shall be available to <br />pay for services performed during the renewal term of said Agreement. Commencing <br />April 7, 2010, and continuing through the term of said Agreement, Consultant shall be <br />paid at the rates and charges set forth in Exhibit A-1, attached hereto and incorporated by <br />this reference. <br />3.
