12.MaritalorDomesticPartnerExtension <br />Subjectotherwisetothetermsandconditionshereof,thisPolicyshallcover Damages arisingfromany Claim made <br />againstthelawfulspouseordomesticpartner(whethersuchstatureisderivedbyreasonofapplicablestatutorylaw, <br />commonlaw,oranyotherapplicablelawanywhereintheworld)ofan InsuredPerson for Claims arisingsolelyout <br />ofhisorhercapacityasthespouseordomesticpartnerofan InsuredPerson,includingsuch Claims thatseek <br />damagesrecoverablefrommaritalcommunityproperty,propertyjointlyheldbythe InsuredPerson andthespouse <br />ordomesticpartner;orpropertytransferredfromthe InsuredPerson tothespouseordomesticpartner;provided, <br />however,thisextensionshallnotaffordcoveragefor WrongfulActs oractsgivingrisetoa PollutionIncident ofthe <br />spouseordomesticpartner.Allterms,conditionsandotherprovisionsofthisPolicy,inclusiveofanyprovisionrelative <br />totheapplicableDeductible,whichwouldbeapplicableto Damages incurredbythe InsuredPerson insuch Claim, <br />shallalsoapplyto Damages incurredbythespouseordomesticpartnerinsuch Claim. <br />13.Severability <br />ExceptwithrespecttotheLimitsofLiabilityandanyrightsordutiesspecificallyassignedtothe FirstNamedInsured <br />statedinItem1.oftheDeclarations,suchasthoserightsanddutiesinSection19.ofthisPolicy,thisinsurance <br />applies: <br />a.asifeach NamedInsured weretheonly NamedInsured;and <br />b.separatelytoeach Insured againstwhom Claim(s)ismadeorsuitisbrought. <br />14.Representations <br />The Insureds representandacknowledgethatthestatementsandinformationcontainedintheApplicationaretrue, <br />accurateandarethebasisofthisPolicyandareincorporatedintoandconstituteapartofthisPolicy;andshallbe <br />deemedmaterialtotheacceptanceofthisriskorthehazardassumedbytheInsurerunderthisPolicy. <br />15.Subrogation <br />IntheeventofanypaymentunderthisPolicy,theInsurerandthe Insured mayhavetherighttorecoverallorpartof <br />anypaymenttheInsurerorthe Insured makesunderthisPolicy.Ifso,thoserightsaretransferredtotheInsurer. <br />The Insured mustdonothingtoimpairsuchrights.The Insured willdoeverythingnecessarytosecuresuchrights <br />andhelptheInsurerenforcethem,includingtheexecutionofdocumentsnecessarytoenabletheInsurertoeffectively <br />bringsuit.Anyrecoverieswillbeappliedasfollows: <br />a.first,totheInsureruptotheamountofitspaymentfor Damages and ClaimExpenses; <br />b.then,tothe Insured asrecoveryofDeductibleamountspaidas Damages and ClaimExpenses. <br />TheInsurerwaivesitsrightsofsubrogationunderthisPolicyagainstclientsoftheTheInsurerwaivesitsrigghtsofsubroggationunderthisPolicyyaggainstclientsofthe InsuredInsured asrespectsasresppects <br /> Claim(s)Claim(()s) <br />arisingfromarisinggfrom ProfessionalServicesProfessionalServices undertheclientÓscontractrequiringwaivundertheclientÓscontractrequiringwaiverofsubrogationbutonlytotheextenterofsubrogationbutonlytothe <br />extent <br />requiredbywrittencontract.requiredbywrittencontract. <br />16.OtherInsurance <br />ThisPolicyshallbeexcessofanyothervalidinsuranceavailabletothe Insured,includinganyproject-specific <br />professionalliabilityinsurance.ThisPolicyshallalsobeexcessofanyDeductibleorself-insuredretentionundersuch <br />otherinsurance. <br />17.Territory <br />ThisPolicyappliesto Claim(s)arisingfrom ProfessionalServices renderedworldwide. <br />However,thisPolicyshallnotapplytoanyriskwhichwouldbeinviolationofthelawoftheUnitedStatesincluding, <br />butnotlimitedto,U.S.economicortradesanctionlawsorexportcontrollawsadministeredbytheU.S.Treasury, <br />State,andCommerceDepartments(e.g.theeconomicandtradesanctionsadministeredbytheU.S.TreasuryOffice <br />ofForeignAssetsControl). <br />RDP 101 (09/18)Page 14 of 16 <br />
