<br />Preparedness Grants Manual <br />4. Administrative and National Policy Requirements <br />In addition to the requirements in this section and the applicable NOFO, FEMA may place specific <br />terms and conditions on individual awards in accordance with 2 C.F.R. Part 200. <br />All grant recipients for FEMA grants and cooperative agreements are required to comply with the <br />DHS Standard Terms and Conditions. <br />The applicable DHS Standard Terms and Conditions will be those in effect at the time the award was <br />made. The specific terms and conditions that will apply for the award will be clearly stated in the <br />award package at the time of award. <br />4.1.Accessibility Compliance <br />Preparedness grant program recipients using funds to build or alter buildings must comply with the <br />applicable accessibility requirements under their local building codes, as well as the Section 504 <br />Rehabilitation Act of 1973, 29 U.S.C. § 794, the Architectural Barriers Act of 1968 (ABA), and the <br />Americans with Disabilities Act (ADA), 42 U.S.C. §§ 12101 et seq., to ensure individuals with <br />disabilities have access to such buildings. State and local governments are required to provide <br />qualified individuals with disabilities equal access to their programs, services, or activities, unless <br />doing so would fundamentally alter the nature of their programs, services or activities or would <br />impose an undue burden. Accessibility standards under the ABA and ADA are highly similar. <br />Additional information regarding compliance with the ABA is available at Chapter 1: Using the ABA <br />Standards on access-board.gov. <br />4.2.Ensuring the Protection of Civil Rights <br />As the Nation works toward achieving the Goal, it is important to continue to protect the civil rights of <br />individuals. Recipients must carry out their programs and activities, including those related to the <br />building, sustainment, and delivery of core capabilities, in a manner that respects and ensures the <br />protection of civil rights for protected populations. <br />Federal civil rights statutes, such as Section 308 of the Robert T. Stafford Disaster Relief and <br />Emergency Assistance Act (Stafford Act), Section 504 of the Rehabilitation Act of 1973, and Title VI <br />of the Civil Rights Act of 1964, Age Discrimination Act, along with DHS and FEMA regulations, <br />prohibit discrimination on the basis of race, color, national origin, sex, religion, age, disability, limited <br />English proficiency, or economic status in connection with programs and activities receiving federal <br />financial assistance from FEMA as applicable. <br />Recipients must complete the DHS Civil Rights Evaluation Tool within 30 days of receiving the first <br />award that fiscal year, not for every award. After initial submittal, an updated submission is due once <br />every two years during which a recipient has an active award. Information about this requirement <br />and a fuller list of the civil rights provisions that apply to recipients can be found in the DHS Standard <br />Terms and Conditions. Additional information on civil rights provisions is available at the Civil Rights <br />Resources for Recipients of DHS Financial Assistance page on DHS.gov and the Office of Equal <br />Rights page on FEMA.gov. <br />Subrecipients are not required to complete or submit the DHS Civil Rights Evaluation tool. However, <br />subrecipients have the same obligations as their primary recipients to comply with applicable civil <br />rights requirements and should follow their primary recipient’s procedures regarding the submission <br />of civil rights information. <br />18
