Changes effective 12/3/24 and later: If the payment standard is increased during the term of the <br />HAP contract, the increased payment standard will be applied no later than the earliest of: <br /> The effective date of an increase in the gross rent that would result in an increase in the <br />family share; <br /> The family’s first regular or interim reexamination; or <br /> One year following the effective date of the increase in the payment standard amount. <br />The PHA may adopt a policy to apply a payment standard increase at any time earlier than the <br />date calculated above as long as the policy is included in the administrative plan and applied <br />consistently to all families [24 CFR 982.505(c)(5)]. <br />SAHA Policy <br />SAHA will not adopt payment standard increases earlier than the date required by <br />the regulations. <br />Changes in Family Unit Size (Voucher Size) [24 CFR 982.505(c)(6) and Notice PIH 2024-34] <br />Changes effective 12/2/24 and earlier: Irrespective of any increase or decrease in the payment <br />standard, if the family unit size increases or decreases during the HAP contract term, the new <br />family unit size must be used to determine the payment standard for the family beginning at the <br />family’s first regular reexamination following the change in family unit size. <br />Changes effective 12/3/24 and later: Irrespective of any increase or decrease in the payment <br />standard, if the family unit size increases or decreases during the HAP contract term, the new <br />family unit size may be used to determine the payment standard immediately but no later than <br />the family’s first regular reexamination following the change in family unit size. <br />SAHA Policy <br />If the family unit size (voucher size) changes during the term of a HAP contract, the new <br />family unit size will be used to determine the payment standard at the family’s first <br />regular reexamination following the change in family unit size. <br />Moves <br />If the family moves to a new unit, or a new HAP contract is executed due to changes in the lease <br />(even if the family remains in place) the current payment standard applicable to the family will <br />be used when the new HAP contract is processed. <br />Reasonable Accommodation [24 CFR 982.503(d)(5)] <br />If a family requires a higher payment standard as a reasonable accommodation for a family <br />member who is a person with disabilities, the PHA is allowed to establish a higher payment <br />standard for the family of not more than 120 percent of the published FMR without HUD <br />approval or prior notification to HUD. A PHA may establish a payment standard greater than <br />120 percent of the applicable FMR as a reasonable accommodation in accordance with 24 CFR <br />part 8, after requesting and receiving HUD approval.
