Administrative Plan 7/1/2025 Page 16-32 <br />Family Debts to the PHA <br />Families are required to reimburse the PHA if they were charged less rent than required because <br />the family either underreported or failed to report income. PHAs are required to determine <br />retroactive rent amounts as far back as the PHA has documentation of family unreported income <br />[Notice PIH 2018-18]. <br />SAHA Policy <br />Any amount owed to SAHA by an HCV family must be repaid by the family. If the <br />family is unable to repay the debt within 30 days, SAHA will offer to enter into a <br />repayment agreement in accordance with the policies below. <br />Criminal Prosecution for Program Fraud/Abuse <br />Local, state or federal criminal prosecution should be considered by the PHA in flagrant cases, if <br />the abuse was committed over several years, the fraud and/or underpayments are substantial and <br />the PHA documents that a family and/or owner willfully intended to misrepresent the truth <br />[HUD OIG Integrity Bulletin, Summer 2015]. <br />SAHA Policy <br />SAHA will consult with the HUD Field Office and regional OIG Special Agent in Charge <br />(SAC) to determine whether it will refer the matter to the state or local district attorney to <br />pursue criminal fraud charges. <br />Refusal to Enter into an Agreement <br />If the family refuses to repay the debt, does not enter into a repayment agreement, or breaches a <br />repayment agreement, the PHA must terminate assistance [Notice PIH 2018-18]. <br />SAHA Policy <br />When a family refuses to repay monies owed to SAHA, in addition to termination of <br />program assistance, SAHA may utilize other available collection alternatives including, <br />but not limited to, the following: <br />Collection agencies <br />Small claims court <br />Civil lawsuit <br />State income tax set-off program <br />Repayment Agreement [24 CFR 792.103] <br />The term repayment agreement refers to a formal written document signed by a tenant or owner <br />and provided to the PHA in which a tenant or owner acknowledges a debt in a specific amount <br />and agrees to repay the amount due at specific time periods. <br />General Repayment Agreement Guidelines for Families <br /> <br /> <br /> <br />EXHIBIT 1
