Administrative Plan 7/1/2025 Page 17-29 <br />Additional Assistance after HAP Contract [24 CFR 983.11(d)] <br />The HAP contract must contain the owner’s certification that the project has not received and <br />will not receive (before or during the term of the HAP contract) any public assistance for <br />acquisition, development, or operation of the housing other than assistance disclosed in the <br />subsidy layering review in accordance with HUD requirements, unless the owner discloses <br />additional assistance in accordance with HUD requirements [24 CFR 983.11(d)]. <br />For newly constructed or rehabilitated housing under a HAP contract, the owner must disclose to <br />the PHA information regarding any additional related assistance from the federal government, a <br />state, or a unit of general local government, or any agency or instrumentality thereof. Related <br />assistance includes but is not limited to any loan, grant, guarantee, insurance, payment, rebate, <br />subsidy, credit, tax benefit, or any other form of direct or indirect assistance. If the additional <br />related assistance meets certain threshold and other requirements established by HUD, a subsidy <br />layering review may be required to determine if it would result in excess public assistance to the <br />project. The PHA must adjust the amount of the housing assistance payments to the owner to <br />compensate in whole or in part for such related assistance. <br />EXHIBIT 1
