Administrative Plan 7/1/2025 Page 17-69 <br />The PHA must not take any of the following actions against a family who has applied for, <br />received, or refused an offer of PBV assistance: <br /> Refuse to list the applicant on the waiting list for tenant-based voucher assistance; <br />- The PHA (or owner in the case of owner-maintained waiting lists) is not required to open <br />a closed waiting list to place the family on that waiting list. <br /> Deny any admission preference for which the applicant is currently qualified; <br /> Change the applicant’s place on the waiting list based on preference, date, and time of <br />application, or other factors affecting selection from the waiting list; <br /> Remove the applicant from the tenant-based voucher waiting list. <br />Acceptance of Offer [24 CFR 983.252(a) and (b)] <br />Family Briefing <br />When a family accepts an offer for PBV assistance, the PHA must give the family an oral <br />briefing. The briefing must include information on how the program works, the responsibilities <br />of the family and owner, and the family’s right to move. <br />In addition to the oral briefing, the PHA must provide a briefing packet that contains the <br />following information: <br /> How the PHA determines the total tenant payment for a family; <br /> The family obligations under the program; <br /> Information on federal, state, and local equal opportunity laws, the contact information for <br />the Section 504 coordinator, a copy of the housing discrimination complaint form, and <br />information on how to request a reasonable accommodation or modification under Section <br />504, the Fair Housing Act, and the Americans with Disabilities Act; <br /> PHA subsidy standards, including when the PHA will consider granting exceptions to the <br />standards, and when exceptions are required as a reasonable accommodation for a person <br />with disabilities under Section 504, the Fair Housing Act, or the Americans with Disabilities <br />Act; and <br /> The family’s right to move. <br />The PHA and family must sign the statement of family responsibility. <br />Persons with Disabilities <br />The PHA must take appropriate steps to ensure effective communication, in accordance with 24 <br />CFR 8.6 and 28 CFR Part 35, subpart E, and must provide information on the reasonable <br />accommodation process in conducting the oral briefing and in providing the written information <br />packet. This may include making alternative formats available (see Chapter 2). In addition, the <br />PHA must have a mechanism for referring a family that includes a member with a mobility <br />impairment to an appropriate accessible PBV unit. <br />EXHIBIT 1
