Administrative Plan 7/1/2025 Page 17-75 <br />Owner Termination of Tenancy [24 CFR 983.257] <br />With two exceptions, the owner of a PBV unit may terminate tenancy for the same reasons an <br />owner may in the tenant-based voucher program (see Section 12-III.B. and 24 CFR 982.310). In <br />the PBV program, terminating tenancy for “good cause” does not include doing so for a business <br />or economic reason, or a desire to use the unit for personal or family use or other non-residential <br />purpose. The regulations at 24 CFR 5.858 through 5.861 on eviction for drug and alcohol abuse <br />and 24 CFR Part 5, subpart L (Protection for Victims of Domestic Violence, Dating Violence, <br />Sexual Assault, or Stalking) apply to the PBV program. <br />In addition, the owner may terminate the tenancy in accordance with the requirements related to <br />lease terminations for development activity on units under a HAP contract and for substantial <br />improvement to units under a HAP contract. <br />Tenant Absence from the Unit [24 CFR 983.256(g) and 982.312(a)] <br />The lease may specify a maximum period of family absence from the unit that may be shorter <br />than the maximum period permitted by PHA policy. According to program requirements, the <br />family’s assistance must be terminated if they are absent from the unit for more than 180 <br />consecutive days. PHA termination of assistance actions due to family absence from the unit are <br />subject to 24 CFR 981.312, except that the unit is not terminated from the HAP contract if the <br />family is absent for longer than the maximum period permitted. <br />Continuation of Housing Assistance Payments [24 CFR 982.258] <br />Housing assistance payments shall continue until the tenant rent equals the rent to owner. The <br />cessation of housing assistance payments at such point will not affect the family’s other rights <br />under its lease, nor will such cessation preclude the resumption of payments as a result of later <br />changes in income, rents, or other relevant circumstances if such changes occur within 180 days <br />following the date of the last housing assistance payment by the PHA. After the 180-day period, <br />the unit shall be removed from the HAP contract pursuant to 24 CFR 983.211. <br />SAHA Policy <br />If a participating family receiving zero assistance experiences a change in circumstances <br />that would result in a HAP payment to the owner, the family must notify SAHA of the <br />change and request an interim reexamination before the expiration of the 180-day period. <br />EXHIBIT 1
