OTHER FEES AND CHARGES [24 CFR 983.354] <br />Meals and Supportive Services <br />With the exception of PBV assistance in assisted living developments, the owner may not require <br />the tenant to pay charges for meals or supportive services. Non-payment of such charges is not <br />grounds for termination of tenancy. <br />In assisted living developments receiving PBV assistance, the owner may charge for meals or <br />supportive services. These charges may not be included in the rent to owner, nor may the value <br />of meals and supportive services be included in the calculation of the reasonable rent. However, <br />non-payment of such charges is grounds for termination of the lease by the owner in an assisted <br />living development. <br />Other Charges by Owner <br />The owner may not charge extra amounts for items customarily included in rent in the locality or <br />provided at no additional cost to unsubsidized tenants in the premises. <br />17-IX.E. PROJECT RECORD RETENTION [24 CFR 983.12] <br />The regulation at 24 CFR 982.158 applies to both the PHA’s tenant-based and project-based <br />programs. In addition, for each PBV project, the PHA must maintain the following records <br />throughout the HAP contract term and for three years thereafter: <br /> Records to document the basis for PHA selection of the proposal, if selection is competitive, <br />or project, if selection is noncompetitive, including records of the PHA’s site selection <br />determination (see 24 CFR 983.55) and records to document the completion of the review of <br />the selection process in the case of PHA-owned units, and copies of the written notice of <br />proposal selection and response of the appropriate party; <br /> The analysis of impact, if applicable; <br /> The subsidy layering determination, if applicable; <br /> The environmental review record, if applicable; <br /> The Agreement to enter into HAP contract (AHAP), if applicable; <br /> Evidence of completion, if applicable; <br /> The HAP contract and any rider and/or amendments, including amendments to extend the <br />term of the contract; <br /> Records to document the basis for PHA determination and redetermination of rent to owner; <br /> Records to document HUD approval of the independent entity or entities, in the case of PHA- <br />owned units; <br /> Records of the accessibility features of the project and each contract unit; and <br /> Other records as HUD may require. <br />EXHIBIT 1
