Administrative Plan 7/1/2025 Page 17-100 <br />EXHIBIT 17-2: Special Provisions Applying to TPVs Awarded as Part of a Voluntary <br />Conversion of Public Housing Units in Projects that Include RAD PBV Units <br />[24 CFR Part 972.200; Notice PIH 2019-05; Notice PIH 2019-23] <br />Under certain circumstances, HUD allows small PHAs to reposition a public housing project (or <br />portion of a project) by voluntarily converting units to tenant-based housing choice voucher <br />assistance. In order to preserve affordable housing for residents of the project, the PHA is given <br />priority to receive replacement tenant protection vouchers (TPVs). As part of the voluntary <br />conversion, the PHA has the option to continue to operate it as rental housing. If so, the PHA or <br />subsequent owner must allow existing families to remain in their units using the TPV in the form <br />of tenant-based assistance. In this situation, however, the PHA may choose to project-base these <br />TPVs in the former public housing project. Families must still be provided with the option to <br />remain in their unit using tenant-based assistance. In order for the PHA to project-base the <br />assistance and include these units on the PBV HAP contract, the family must voluntarily consent <br />in writing to PBV assistance following the requirements in Appendix A of Notice PIH 2019-05. <br />If the family fails to consent to PBV assistance and chooses to remain using tenant-based <br />assistance, the family’s unit is excluded from the PBV HAP contract until the family moves out <br />or consents to switching to PBV assistance. In general, all applicable program regulations and <br />guidance for the standard PBV program apply to these units. <br />The PHA may also convert units in the same former public housing project to the PBV program <br />under the rental assistance demonstration (RAD) program. The RAD statute authorizes HUD to <br />waive certain statutory and regulatory provisions governing the standard PBV program and <br />specify alternative requirements. In order to facilitate the uniform treatment of residents and <br />units at the project, Notice PIH 2019-23 extended some of the alternative requirements to non- <br />RAD PBV units in the converted project (i.e., the TPV units in the project). As such, while PBV <br />TPV units in the converted project generally follow the requirements for the standard PBV <br />program listed in this chapter, where HUD has specified alternative requirements for non-RAD <br />PBV units in the project, PBV TPV units will instead follow the requirements outlined in <br />Chapter 18 of this policy for the RAD PBV program. <br />RAD Requirements Applicable to Non-RAD units in the Project <br />Alternative Requirement <br />under RAD as Listed in <br />Notice PIH 2019-23 <br />Standard PBV Policy <br />That Does Not Apply <br />Applicable Policy in Chapter 18 <br />1.6.A.4.
