EXHIBIT 1 <br />Special Housing Types [Notice PIH 2O13-19 and NED Category 2 FAQs] <br />In general, a PHA is not required to permit families to use any of the special housing types and <br />may limit the number of families using such housing. However, the PHA must permit the use of <br />a special housing type if doing so provides a reasonable accommodation so that the program is <br />readily accessible to and usable by a person with disabilities. <br />Such special housing types include single room occupancy housing, congregate housing, group <br />homes, shared housing, cooperative housing, and manufactured homes when the family owns the <br />home and leases the manufactured home space. <br />Persons with disabilities transitioning out of institutional settings may choose housing in the <br />community that is in a group or shared environment or where some additional assistance for <br />daily living is provided for them on site. Under HUD regulations, group homes and shared <br />housing are considered special housing types and are not excluded as an eligible housing type in <br />the HCV program. Assisted living facilities are also considered eligible housing under the <br />normal HCV program rules, as long as the costs for meals and other supportive services are not <br />included in the housing assistance payments (HAP) made by the PHA to the owner, and as long <br />as the person does not need continual medical or nursing care. <br />18-IV.E. PORTABILITY [NED Category 2 FAQs] <br />NED voucher participants are eligible for portability under standard portability rules and all PHA <br />policies regarding portability in Chapter 10, Part II apply to NED families. However, the PHA <br />may, but is not required to, allow applicant NED families to move under portability, even if the <br />family did not have legal residency in the initial PHA's jurisdiction when they applied. <br />SAHA Policy <br />If neither the head of household nor the spouse or cohead of a NED applicant family had <br />a domicile (legal residence) in SAHA's jurisdiction at the time that the family's initial <br />application for assistance was submitted, the family must lease a unit within the initial <br />SAHA's jurisdiction for at least 12 months before requesting portability. <br />SAHA will consider exceptions to this policy for purposes of reasonable accommodation <br />(see Chapter 2) or reasons related to domestic violence, dating violence, sexual assault, <br />stalking, or human trafficking. <br />- 025 <br />City Council 5 — 900 5 2 25 <br />
