Administrative Plan 7/1/2025 <br /> <br />Page 3-38 <br />(B) Infants and Young Children <br />An individual from birth to age 9, inclusive, who has a substantial developmental delay <br />or specific congenital or acquired condition, may be considered to have a developmental <br />disability without meeting 3 or more of the criteria described in clauses (i) through (v) of <br />subparagraph (A) if the individual, without services and supports, has a high probability <br />of meeting those criteria later in life. <br /> Has a physical, mental, or emotional impairment that is expected to be of long-continued and <br />indefinite duration; substantially impedes their ability to live independently, and is of such a <br />nature that the ability to live independently could be improved by more suitable housing <br />conditions. <br />People with the acquired immunodeficiency syndrome (AIDS) or any conditions arising from the <br />etiologic agent for AIDS are not excluded from this definition. <br />A person whose disability is based solely on any drug or alcohol dependence does not qualify as <br />a person with disabilities for the purposes of this program. <br />For purposes of reasonable accommodation and program accessibility for persons with <br />disabilities, the term person with disabilities refers to an individual with handicaps. <br />EXHIBIT 1
