Administrative Plan 7/1/2025 Page 7-46 <br />7-IV.B. HEALTH AND MEDICAL CARE EXPENSE DEDUCTION <br />Policies related to medical expenses are found in Chapter 6. The amount of the deduction will be <br />verified following the standard verification procedures described in Part I. <br />The PHA must comply with the Health Insurance Portability and Accountability Act (HIPAA) <br />(Pub. L. 104-191, 110 Stat. 1936) and the Privacy Act of 1974 (Pub. L. 93-579, 88 Stat. 1896) <br />when requesting documentation to determine unreimbursed health and medical care expenses. <br />The PHA may not request documentation beyond what is sufficient to determine anticipated <br />health and medical care costs. Before placing bills and documentation in the tenant file, the PHA <br />must redact all personally identifiable information [FR Notice 2/14/23]. <br />Amount of Expense <br />SAHA Policy <br />Medical expenses will be verified through: <br />Written third-party documents provided by the family, such as pharmacy printouts <br />or receipts. <br />When income is projected at new admission or interim, SAHA will make a best <br />effort to determine what expenses from the past are likely to continue to occur in <br />the future. SAHA will also accept evidence of monthly payments or total <br />payments that will be due for medical expenses during the upcoming 12 months. <br />Written third-party verification forms if the family is unable to provide acceptable <br />documentation. <br />When income is projected at new admission or interim, if third-party or document <br />review is not possible, written family certification as to costs anticipated to be <br />incurred during the upcoming 12 months. <br />Before placing bills and documentation in the tenant file, SAHA will redact all personally <br />identifiable information. <br />If SAHA receives documentation from a verification source that contains the individual’s <br />specific diagnosis, information regarding the individual’s treatment, and/or information <br />regarding the nature or severity of the person’s disability, SAHA will immediately <br />dispose of this confidential information; this information will never be maintained in the <br />individual’s file. If the information needs to be disposed of, SAHA will note in the <br />individual’s file that verification was received, the date received, and the name and <br />address of the person/organization that provided the verification. Under no circumstances <br />will PHA include an applicant’s or resident’s medical records in the file [Notice PIH <br />2010-26]. <br />If items are recommended by a knowledgeable professional, the family must provide <br />verification from the knowledgeable professional that such item is needed (e.g. <br />acupuncture, herbal supplements.) <br />EXHIBIT 1
