Administrative Plan 7/1/2025 <br />. <br />Page 8-9 <br />8-I.D. OWNER AND FAMILY RESPONSIBILITIES [24 CFR 982.404] <br />The following is applicable to HAP contracts executed or renewed June 5, 2024 , or earlier: <br />Family Responsibilities <br />The family is responsible for correcting the following HQS deficiencies: <br /> Tenant-paid utilities not in service <br /> Failure to provide or maintain appliances owned by the family <br /> Damage to the unit or premises caused by a household member or guest beyond ordinary <br />wear and tear that results in a breach of the HQS. Ordinary wear and tear is defined as items <br />which could not be charged against the tenant’s security deposit under state law or court <br />practice. <br />Owner Responsibilities <br />The owner is responsible for all HQS violations not listed as a family responsibility above, even <br />if the violation is caused by the family’s living habits (e.g., vermin infestation). However, if the <br />family’s actions constitute a serious or repeated lease violation, the owner may take legal action <br />to evict the family. <br />SAHA Policy <br />The owner is responsible for all housing quality violations not listed as a family <br />responsibility above, even if the violation is caused by the family’s living habits (e.g., <br />vermin infestation). However, if the family’s actions constitute a serious or repeated lease <br />violation, the owner may take legal action to evict the family. <br />The owner will be required to repair an inoperable smoke detector unless SAHA <br />determines that the family has intentionally disconnected it (by removing batteries or <br />other means). In this case, the family will be required to repair the smoke detector within <br />24 hours. <br />If an owner fails to correct life-threatening conditions as required by SAHA, SAHA will <br />enforce the housing quality standards in accordance with HUD requirements. See 8-II.G. <br />The following is applicable to HAP contracts executed or renewed June 6, 2024 , or later: <br />Owner Obligation <br />The owner must maintain the unit in accordance with housing quality standards. A unit is not in <br />compliance with housing quality standards if the PHA or other inspector authorized by the state <br />or local government determines that the unit has housing quality standards deficiencies based <br />upon an inspection, notifies the owner in writing of the deficiencies, and the deficiencies are not <br />remedied within the appropriate time frame. <br />EXHIBIT 1
