Administrative Plan 7/1/2025 Page 17-4 <br />A PHA-owned unit is a dwelling unit in a project that is: <br /> Owned by the PHA (including having a controlling interest in the entity that owns the <br />project); <br /> Owned by an entity wholly controlled by the PHA; or <br /> Owned by a limited liability company or limited partnership in which the PHA (or an entity <br />wholly controlled by the PHA) holds a controlling interest in the managing member or <br />general partner. <br />- A controlling interest is: <br /> Holding more than 50 percent of the stock of any corporation; <br /> Having the power to appoint more than 50 percent of the members of the board of <br />directors of a non-stock corporation (such as a nonprofit corporation); <br /> Where more than 50 percent of the members of the board of directors of any <br />corporation also serve as directors, officers, or employees of the PHA; <br /> Holding more than 50 percent of all managing member interests in an LLC; <br /> Holding more than 50 percent of all general partner interests in a partnership; or <br /> Equivalent levels of control in other ownership structures. <br />A project can be a single building, multiple contiguous buildings, or multiple buildings on <br />contiguous parcels of land. “Contiguous” in this definition includes “adjacent to,” as well as <br />touching along a boundary or a point. A PHA may, in its administrative plan, establish the <br />circumstances under which it will define a project as only one of the following: a single building, <br />multiple contiguous buildings, or multiple buildings on contiguous parcels of land. <br />PHA Policy <br />SAHA will not define circumstances that limit the definition of the term project. <br />Rehabilitated housing is a project which is developed for use under the PBV program, in which <br />all proposed contract units exist on the proposal or project selection date, but which does not <br />qualify as existing housing. <br />A qualified census tract is any census tract (or equivalent geographic area defined by the Bureau <br />of the Census) in which at least 50 percent of households have an income of less than 60 percent <br />of Area Median Income (AMI), or where the poverty rate is at least 25 percent and where the <br />census tract is designated as a qualified census tract by HUD. <br />EXHIBIT 1
