<br /> <br />Ordinance No. NS-XXX <br />Page 26 of 27 <br /> <br />or authorize any person or entity other than the person or entity named in the <br />permit to operate the group home named therein. <br /> <br />Sec. 8-3603 - Reapplication after denial or revocation. <br /> <br />(a) An applicant for an Operator's Permit whose application for such an Operator's <br />Permit has been denied may not reapply for such an Operator's Permit for a period <br />of 180 days from the date such notice of denial was issued. <br /> <br />(b) A holder of an Operator's Permit that has been cancelled, revoked or otherwise <br />invalidated may not reapply for an Operator's Permit for a period of 180 days from <br />the date that such revocation, cancellation or invalidation became final. <br /> <br />Sec. 8-3604. Compliance <br />A group home that is subject to the provisions of this Article that is in existence as of the <br />effective date of this ordinance shall have 120 days to comply with the provi sions of this <br />Article. <br /> <br />Sections 8-3605-8-3699. Reserved. <br /> <br />Section 29. If any section, subsection, sentence, clause, phrase or portion of this <br />ordinance is for any reason held to be invalid or unconstitutional by the decision of any <br />court of competent jurisdiction, such decision shall not affect the validity of the remaining <br />portions of this ordinance. The City Council of the City of Santa Ana hereby declares that <br />it would have adopted this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one or more sections, <br />subsections, sentences, clauses, phrases, or portions be declared invalid or <br />unconstitutional. <br /> <br />Section 30. The City Council of the City of Santa Ana hereby adopts an <br />ordinance amending various sections of Chapter 41 (Zoning) of the Santa Ana Municipal <br />Code pertaining to group homes and land use definitions in Chapter 41 of the SAMC. This <br />approval was based upon the evidence submitted at the above said hearing, which <br />includes, but is not limited to: the Request for City Council Action dated August 19, 2025, <br />and exhibits attached thereto; and the public testimony, all which are incorporated herein <br />by reference. <br /> <br />Section 31. This ordinance shall become effective thirty (30) days after its <br />adoption. <br /> <br />Section 32. The City Clerk shall certify the adoption of this ordinance and shall <br />cause the same to be published as required by law. <br /> <br /> <br /> <br /> <br /> <br /> <br />
