<br /> Resolution No. 2025-XX <br />Page 1 of 9 <br /> <br />RESOLUTION NO. 2025-XX <br /> <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF SANTA ANA APPROVING CONDITIONAL USE PERMIT <br />NO. 2025-01 AS CONDITIONED TO ALLOW THE AFTER- <br />HOURS OPERATIONS OF A DRIVE-THROUGH FROM 6:00 A.M. <br />UNTIL 1:00 A.M. SUNDAY THROUGH THURSDAY, AND 6:00 <br />AM UNTIL 1:30 A.M. FRIDAY AND SATURDAY AT AN EATING <br />ESTABLISHMENT LOCATED AT 2600 S. BRISTOL STREET <br />(APN: 412-201-07) <br /> <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA AS FOLLOWS: <br /> <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines, and declares as follows: <br /> <br />A. Cotti Foods California, Inc. (“Applicant”), representing Wendy’s Restaurant <br />(“Wendy’s”), is requesting approval of Conditional Use Permit (CUP) No. 2025- <br />01 to allow the after-hours operation of a drive-through for a proposed eating <br />establishment located at 2600 S. Bristol Street (“Project”). <br /> <br />B. Santa Ana Municipal Code (“SAMC”) Section 41-412.5 (d) requires approval <br />of a CUP for eating establishments open at any time between the hours of <br />12:00 a.m. and 5:00 a.m., and located within 150 feet of residentially used or <br />zoned properties (measured from property line to property line) in the Planned <br />Shopping Center (C4) zoning district. <br /> <br />C. On June 26, 1989, the City of Santa Ana Planning Commission held a public <br />hearing for the proposal of a new drive-through restaurant located at 2600 S. <br />Bristol Street, for a Kentucky Fried Chicken (KFC). The Planning Commission <br />approved CUP No. 1989-12 to allow a drive-through, and variance (VA) No. <br />1989-12 to allow a reduction of a 15-foot street setback requirement. As part <br />of the approval, the Planning Commission limited the hours of the drive-through <br />from 11:00 a.m. to 9:00 p.m. <br /> <br />D. The KFC restaurant occupied the building from 1989 until 2024, when KFC <br />ceased operations. <br /> <br />E. On December 5, 2024, Wendy’s applied for a Certificate of Occupancy to <br />occupy 2600 S. Bristol Street as an eating establishment. However, the <br />proposed drive-through hours of operation require a new CUP for after-hours <br />operations between 12:00 a.m. and 6:00 a.m. and within 150 lineal feet of <br />residential properties and zones. <br /> <br />F. On January 27, 2025, the Planning Commission held a duly-noticed public <br />hearing on CUP No. 2025-01. <br />
