Resolution No. 2025-XX <br />Page 1 of 15 <br />RESOLUTION NO. 2025-XX <br /> <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF SANTA ANA APPROVING CONDITIONAL USE <br />PERMIT NO. 2025-02 AS CONDITIONED AND MAKING A <br />DETERMINATION OF PUBLIC CONVENIENCE OR <br />NECESSITY TO ALLOW THE SALE OF BEER, WINE, AND <br />DISTILLED SPIRITS, FOR OFF-PREMISES CONSUMPTION <br />FOR OLE CITY MARKET LOCATED AT 1623 W. <br />SEVENTEENTH STREET (APN: 399-121-03) <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA AS FOLLOWS: <br /> <br /> Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines, and declares as follows: <br /> <br />A. David Oh with Top Food Makers, Inc. (“Applicant”), on behalf of Bolsa-Bushard, <br />LLC (“Property Owner”), is requesting approval of Conditional Use Permit <br />(“CUP”) No. 2025-02 and a determination of Public Convenience or Necessity <br />(“PCN”) to allow the sale of beer, wine and distilled spirits, for off-premises <br />consumption through the operation of a Type-21 Alcoholic Beverage Control <br />(ABC) license at a new grocery store (“Ole City Market”) proposed to be located <br />at 1623 W. Seventeenth Street (“Project”). <br /> <br />B. Santa Ana Municipal Code (“SAMC”) Section 41-196 requires approval of a <br />CUP for establishments wishing to sell alcoholic beverages for off-premises <br />consumption. <br /> <br />C. On July 25, 1994, the City of Santa Ana Planning Commission approved CUP <br />No. 1994-08 allowing the sale of beer and wine for off-premises consumption <br />for a grocery store (Northgate Gonzales Market) at 1623 W. Seventeenth <br />Street. <br /> <br />D. On March 9, 2015, the Planning Commission approved CUP 2015-04 allowing <br />an existing grocery store (Northgate Gonzales Market) to upgrade from a Type <br />20 ABC license to a Type 21 ABC license in order to sell beer, wine, and <br />distilled spirits for off-premise consumption at 1623 W. Seventeenth Street. <br /> <br />E. A CUP is a land use approval which runs with the land and may be continued <br />perpetually, provided that the property is not vacated for a period of more than <br />12-months. The Northgate Gonzales Market business located at 1623 W. <br />Seventeenth Street, which was in receipt of CUP No. 2015-04, vacated the <br />subject property and the property remained vacant for more than 12 <br />consecutive months. Therefore, CUP No. 2015-04 is considered expired and <br />null and void. <br /> <br />F. SAMC Section 41-645.5 and California Business and Professions Code <br />
