<br />project proposes increasing the amount of outdoor seating area
<br />in response to changing business trends within the restaurant
<br />industry and to remain competitive within the marketplace with
<br />a more unique outdoor dining experience.
<br />
<br /> Goal UD-1 supports improvement of the physical character and
<br />livability of the city to promote a sense of place, positive
<br />community image, and quality environment. Policy 1.5 of the UD
<br />encourages community interaction through the development
<br />and enhancement of plazas, open space, people places, and
<br />pedestrian connections with the public realm. The proposed
<br />project would facilitate enhancement of the public realm through
<br />providing a space for customer social interaction with ease of
<br />access to heavier pedestrian trafficked areas.
<br />
<br /> Goal UD-2 encourages the improvement of the built
<br />environment through sustainable development that is
<br />proportional and aesthetically related to its setting. Moreover,
<br />Policy 2.10 of the UD promotes sustainable development
<br />through the use of drought-tolerant landscaping, permeable
<br />hardscape surfaces, and energy sufficient building design and
<br />construction. The proposed project expands the square footage
<br />of outdoor dining area and use of the site while maintaining
<br />existing building square footage and high-quality landscaped
<br />areas that are visible to public areas.
<br />
<br /> Section 2. In accordance with the California Environmental Quality Act (CEQA)
<br />and the CEQA Guidelines, the Project is categorically exempt from further review per
<br />Section 15301 (Class 1 – Existing Facilities). Class 1 exemption applies to the operation,
<br />repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public
<br />or private structures, facilities, mechanical equipment, or topographical features,
<br />involving negligible or no expansion of existing or former use. The Project proposes to
<br />allow the upgrade of an existing alcoholic beverage control license to sell alcoholic
<br />beverages at an existing bona-fide eating establishment, with negligible expansion of the
<br />existing use proposed, which is proposed to be less than 10,000 square feet and within
<br />an area with access to all public services and facilities, and is not located within an
<br />environmentally sensitive area . As such, a Notice of Exemption, Environmental Review
<br />No. 2015-109, will be filed for this Project.

<br />Section 3. The Applicant shall indemnify, protect, defend and hold the City and/or
<br />any of its officials, officers, employees, agents, departments, agencies, authorized
<br />volunteers, and instrumentalities thereof, harmless from any and all claims, demands,
<br />lawsuits, writs of mandamus, referendum, and other proceedings (whether legal,
<br />equitable, declaratory, administrative or adjudicatory in nature), and alternative dispute
<br />resolution procedures (including, but not limited to arbitrations, mediations, and such
<br />other procedures), judgments, orders, and decisions (collectively “Actions”), brought
<br />against the City and/or any of its officials, officers, employees, agents, departments,
<br />agencies, and instrumentalities thereof, that challenge, attack, or seek to modify, set
