The Village Santa Ana Specific Plan Entitlements & Development Agreement (1561 W. <br />Sunflower Avenue) <br />August 11, 2025 <br />Page 18 <br /> <br /> <br /> <br />Deal Point Ad Hoc Committee <br />Recommendation <br />Proposed by DA <br />Community Benefit <br />Payments <br />Accept Community Benefit <br />Payment of $9,300,000 but <br />provide a larger upfront payment <br />and provide payments in less <br />intervals. <br />Applicant has revised the proposed <br />agreement to provide the Community <br />Benefit Payment in four payments instead <br />of five and increased Payment No. 1 by <br />$500,000. Payments will be provided as <br />follows: <br />• Payment No. 1 of $2,500,000 prior to <br />demolition permits being issued; <br />• Payment No. 2 of $3,600,000 prior to <br />permit issuance of Phase 2 <br />• Payment No. 3 of $1,300,000 prior to <br />permit issuance of Phase 3 <br />• Payment No. 4 of $1,900,000 prior to <br />permit issuance of Phase 4 <br />Open Space Accept the construction of 7.5 <br />acres of publicly accessible <br />open space to satisfy the City’s <br />park provision and fee <br />requirements. The developer <br />must enter into a public access <br />easement for the publicly <br />accessible open space, which <br />must be recorded against the <br />Property Site for the life of the <br />Project. <br />Applicant has agreed to these terms. <br /> <br />The SEIR prepared for the Project <br />identifies that the Project will result in a <br />demand for 11.4 acres of parkland, which <br />is 3.9 acres more than the 7.5 acres being <br />proposed. However, the Project will remain <br />consistent with the General Plan pursuant <br />to Table OS-3 (Open Space Element <br />Implementation) of the General Plan, <br />Action Nos. 1.7 and 1.10. Action No. 1.7, <br />which recognizes the challenges and <br />difficulty in creating new open space and <br />parklands in a built-out environment and <br />provides for a reduction in on-site open <br />space by giving credits for park land for <br />public use as an incentive toward <br />developer creation of open space areas <br />that are accessible to the public. Action <br />No. 1.10 encourages collaboration with <br />property owners to provide public access <br />and programming on private open space. <br />Inclusionary Housing <br />Fee <br />Accept payment of $5 per <br />square feet of habitable space <br />Applicant has agreed to these terms. <br /> <br />Pursuant to SAMC Section 41-1903(a), the <br />Applicant has proposed a development <br />agreement to comply with Section 41-1904 <br />of the SAMC, allowing payment of in-lieu <br />fees. SAMC Section 41-1904 provides <br />options to satisfy the AHOCO, including <br />on-site units, off-site units, and payment of <br />in-lieu fees. For projects containing 20 or <br />more units, the in-lieu fee is as high as $15 <br />per square feet, but may be as low as $5 <br />per square feet if determined by a <br />development agreement or if using skilled <br />and trained workforce.
