6 <br />I. INTRODUCTION <br />These are the Funding Terms and Conditions (FT&C) for childcare and development <br />contracts effective July 1, 2024. Each contractor is required as a condition of its <br />contract (Contract) with the California Department of Social Services (CDSS), to <br />adhere to the following laws and documents: <br />A. Title 45 Code of Federal Regulations (45 CFR, Part 98, and Part 99) <br />B. Any applicable Welfare and Institutions Code (WIC) statutes; <br />C. Title 5 California Code of Regulations (5 CCR) Division 1, Chapter 19 and 19.5, <br />Sections 18000 et seq. <br />D. Title 22 California Code of Regulations (22 CCR), Division 12, community care <br />facilities license regulations, including childcare centers; <br />E. The FT&C; <br />F. The specific Program Requirements; <br />G. The CDSS Audit Guide; <br />H. The California School Accounting Manual; <br />I. The procedures and standards set forth in the Uniform Administrative <br />Requirements, Cost Principles, and Audit Requirements for Federal Awards, (2 <br />CFR Part 200 and 45 CFR Part 75), hereinafter referred to as Uniform Guidance <br />(UG); <br />J. Pilot Plan addendum for agencies participating in approved Individualized Child <br />Care Subsidy plan, pursuant to Chapter 187, Part 1.8, Division 9 of WIC <br />commencing with Section 10350. <br />K. In addition to all other applicable laws and regulations, including any applicable <br />law and regulations that may become effective during the term of this contract. <br />Any non-compliance with these provisions may subject the contractor to termination <br />of the contract. Any variance from The Contract must be authorized in writing by the <br />CDSS and signed by the Deputy Director of the Childcare and Development Division <br />(CCDD) or the Deputy Director’s authorized representative. Unless otherwise noted, <br />these compliance requirements apply to all programs. <br />Contractors may adopt any reasonable policies relating to the administration of the <br />program so long as such policies are not in conflict with law, regulations, or the <br />terms of the Contract, including any amendments. Those potentially affected by the <br />policies shall be duly notified, as provided for in statute and regulation, and be <br />afforded all required due process.
